*headscratch* This thread has me a bit concerned. Since Windstone can claim a copyright to ANY of the color schemes it produces, that would include all of the test paint and one of a kind pieces, correct? Which are being produced by the dozens, soon to be hundreds.
What happens, if you produce a scheme that closely resembles that of another artist? Say, me, for example. Inadvertantly. But then you come across my website at a later date, and decide that my artwork is too close to yours. Would that be persuable? I’m just little me, and you have all the lawyer power. 🙁
With all the paint jobs being done, eventually you are going to chance across something pretty much identical to one of mine. And it is very disheartening to think that I will someday be on the wrong side of a cease and desist. It’s bad enough my dragon types look a bit like a lap dragon (the horns are bang on, and the tail is similar, though all else is very different – to be fair, I made mine first!) And now that I think about it, there was an artist edition that made me say to hubby “that one looks exactly like Natta’s color!” (My dragons are few enough, each has a name). And yes, I plan to publish books someday, probably illustrated, so I will be making a profit off my designs even if I am not doing so right this minute.
I believe Windstone has already trademarked a species name I was going to use. But we don’t have the monies to officially put trademarks on eveything I come up with. *sad*
I was just looking at some of the previously pursued cases listed above, and I thought some of them were a bit far fetched on being ripoffs. In particular, I don’t think that the Merfle Munchies ones look anything like a windstone at all, sculpt wise, (except perhaps the rainbow scheme being similar).
But then I turn it around… Melody is working on a Lava color scheme? Merfle Munchies already has a Lava scheme… does that mean that artist could take action against Windstone? So it is really confusing…
I’ve loved Windstones since the flion was originally in stores, so I’ve been around a good long while. But the sheer… I dunno… aggressiveness of the company is a put-off. I know nobody likes to be copied, but really… it’s like a vampire hunt or something.
Sorry, it’s late, and I have probably said too much. *le sigh* Maybe I just need a bit of reassuring that it isn’t as bad for us little guys as it seems from the postings above.
I was finally able to get into photobucket (the upload wasn’t working for several days, how odd!) and now have piccies of my two new lovelies!
This one, I am totally keeping. I mean, he’s so awesome, he even matches my test paint griffin. ^.^ Well, in person they match, both are pretty interference-y.
And this little guy… he is SO hard to photograph! He is black, with alot of silver layered over the black on his head and back, so he is very shiney. In low light, all you see is his blaze and stockings. I am debating trading or selling him… when I first opened the box, I was all ‘yep, reseller!’ (since my original plan was choose one to keep and one to sell). But every day, I like him a bit more, and am now leaning more towards keeping. But offer if you like, in trades or dollars.
I got my two babies tonight! As an added bonus, I didn’t get charged any duty fees on the package! Hooray! I am really stoked, too, I got one that I just absolutely adore! *squee!* I got the little coppery/brown and black mottled one. 😀
Alas, I can’t post any pictures, because photobucket won’t let me upload for some reason. I will try again tomorrow night.
Lots more! I will *definitely* buy an open eyed red panda, so long as it has brown eyes. ^.^ I only missed this round by minutes! *pout*
I will squeek too! I have every intention of getting one – but I was a few minutes too late. Very sad. *tear*
Hooray! The postal strike is over, and I was finally able to get my hands on my babies!

I got a very simple, blue eyed palomino? And a darker one (bay?). They grey on the darker one is not as ‘bright’ in person, I think the flash made it turn out a lighter color.

As far as trading goes, I might trade either one. I was really hoping to get a brown one, but I’m not fond of the grey color mane and tail. And I didnt’ like the palo pics at first, but this little guy is growing on me fast! I also would/might sell either one for the right price. (My original plan was to get two, pick one, and sell the other… but I do like them both equally and can’t decide on just one to keep!)
This is… fascinating! I never knew there was a line like BATTAT. They look familiar, but how would I recognize one if I saw it? Are they stamped?

I’d love to see one in any neutral/natural color. The metallics, and blues, and celtic knot are nice but I prefer something more organic. My momma poad is a brown bengal, and I would like anything to match her. So anything brown, greyish would be awesome. If they were blue, or too complex, I would probably pass and wait for something else. (That said, is there any way I can get on a notification list for the store, when it restocks?)

Fluffy was…surprised…by his prostate exam. It was the kind of surprise that took a few moments off of his life, but mostly due to indigestion brought about from eating a veterinarian too fast.
That’s just about what I was going to caption, though I was thinking more along the lines of a cold thermometer.
If somebody, anybody, has a prototype Old Warrior they would like to see in a permanent home where he will be very much cherished, be sure to let me know! And I thought Melody meant me! Since I also forgot my password and had to re-register. 😛 (I used to be Thunderwing).
I’ve been having troubles the last couple weeks with logging in. Granted, I only tried a few times, I have not been online much. I forgot my password, and tried to use the forgotten password option, but when I use it I get no email. Checked my Spam folder. I was able to email Melody directly, though. I created this new account (I used to be called Thunderwing). I don’t mind keep this account instead of the old one, I like this name better. However… I wanted to point out to the persons in charge that there may be a problem with the password reset/retrieve. Or it might just be my account?
