I know the general principle is to keep people that have the potential to do you harm at a distance from you, and if they get too close ie. stalking and such, you can call the cops, kind of like violating parole? maybe? I don’t know any of the details or specifics though.
I hope that made more sense to you than it did to me……Someone else can probably explain it WAY better…
December 17, 2006 at 9:03 am #516891Doesn’t sound like it does much good. Who would care about what the law says if they’ve already broken it enough to earn a restraining order anyway? And why should anybody bother with cops when they can take care of themselves? I hate it when the government thinks it needs a monopoly on everything including safety.

A restraining order is just a court order not to go within a set distance of a person. Since they are neighbors, it may be, say, 100ft. If they do, the cops can be called and hey get charged with violating a court order. It does offer protection, and she can get one that will keep them off the property, too. I honestly just hope they get evicted, but Dragon, watch your stuff if they do. They usually get 30 days to move out.
December 17, 2006 at 3:51 pm #516893I think the restraining order is a good idea too. Then they legally can’t come close to the house, and it might make them think twice about trying anything.
Plus, Drag0n will probably get priority if she has to call the cops, since it’ll be in regards to an actual crime (violating the restraining order).

Restraining orders won’t stop people from coming on your property or near you. It is just a piece of paper that offers little deterrence from motivated and/or repeat offenders. However, it is useful because is allow violators to get in trouble or recieve harsher penalties if they do. It is not a bad idea to have one, but only if you know it is for punishment and will not save you or your property from harm.
December 17, 2006 at 6:30 pm #516895Agreed, Lokie. I just think I’d be better off taking care of myself in a situation like that rather than waiting for the cops to take care of it. If you call them when the neighbors are too close, either you’re already in trouble and the cops can basically pick up the pieces, or you sound paranoid as you try to prove that the jerks came closer than 100 ft to you. Harsher penalty or not, it doesn’t seem to be a well-thought-out system

They will certainly get theirs, but in the meantime, I hope your cats are all housecats… but if they arent, keep them IN. These people sound like whackjobs and if she was willing to throw her own son under the bus, imagine what she would be willing to do to your cat!

December 18, 2006 at 3:39 am #516899I am glad to hear that you got your stuff back dragOn. A restraining order is a good idea, but I don’t think you can get one unless they do damage to you. Also remember if they get evicted then you won’t know where they live for the restraining order or to tell the cops. I agree with everyone else…keep your guard up. It is too bad about their kid, but it could of been worse. People on Meth do really stupid stuff and steal to get more money for drugs. I will also tell the cops that you still want to press charges, maybe that will help you get the restraining order. Hopefully nothing else will happen. It really sucks when people are friends or neighbors for a long time and they turn around and stab you in the back. It has caused me to not trust that many people.

This does not sound like the best of situations and if you believe they are the type to consider retaliation it is probably time to be extra cautious.

I think that is reference to the mom saying the boy took the camera – she probably figured the cops wouldn’t arrest a 4 year old but she did blame him for the camera.

Just keep the doors locked, and if they break something you can get them on “willful distruction of property” or if they come in you can get them for “Breaking and entering” either way they will be dried out for a bit, maybe it will help them get their $h1+ in a pile. 😆
December 18, 2006 at 6:52 am #516903I don’t know how hard it is to get a restraining order, but we have had a couple instances in my family in which we actually had to get one – I can tell you one thing, even if it doesn’t ACTUALLY do any good (though I personally think it does) it sure does act as a good deterent. If they know you have a restraining order against them, it is a lot less likely that they will want to bother you. Plus, when you call the police because they’re trespassing, they’ll actually COME if you have a restraining order, which sadly, they probably won’t if you don’t have one.

If somebody really wants to harm another person, he will, no matter what the law says, and the RO is useless. I’d think an RO only acts as a deterrent to someone who still has a little respect for the law, in which case one shouldn’t have too much trouble with them anyway and you can take care of yourself without involving any arbitrarily-acting cops.
