Yes, that egg with the three coming out of it is what I would definitely consider to be an infringement.

So what can Windstone do about something like that? Can they get this item off the market if it came down to it?
November 24, 2009 at 8:55 pm #708725If they can find the manufacturers and John and the lawyer decide that it is worth perusing, they will peruse it, yes.
The problem with many eBay listings is that it is just individuals that are reselling items they bought elsewhere, and are probably unaware that it’s a problem in the first place. Unless the source of the piece is known, it’s hard to do much.

December 4, 2009 at 11:59 pm #708727I’ve been off the site for a while. Every time I have seen these on ebay I know they don’t seem right. It looks like the mother dragon. Same position and everything. I will be happy to report it but I don’t want to overstep my bounds and be a pain. (and make sure I’m reading the copyright infringment stuff right).
The same seller has this one too for sale. It looks a lot like the male dragon.
There might be more in there. This seller has a large quantity of items. They have had these for sale for a long time on ebay…

You are quite right.. these are probably infringements. John has been aware of these particular ones for a while but I don’t know what he has been able to do. Thank you very much for your vigilance. 🙂

This girl made a gum-paste mold of the “secret keeper” Windstone dragon and is selling prints of the photo she took of it, and no credit was given to Windstone in the image desc: http://raynich2.deviantart.com/art/Pastillage-Myth-146559063 :/ (I went ahead and emailed Melody about it, since I thought this might be a violation of Windstone’s copyright, even if it was made of edible material.)

Thing that grinds me so much is they were trying to sell prints of the picture. 👿

December 17, 2009 at 1:00 am #708732I was cruising around on Google for sale and found these. Interesting color scheme (peacock?). Are they close enough to be an infringement? I just can’t figure out who makes them. A lot of places are selling them online.

December 17, 2009 at 9:41 pm #708733Thank you very much, ForestDragon! Those are indeed a known ‘problem’. The color scheme, placement of the colors, and gold details are indeed thought to be an infringement and I believe John knows about them.

Wish I could have seen that picture. I’m curious how he – that “artist” is a guy, from the looks of his DA profile – presented the mold. He couldn’t have gotten it off a real SK.
