Copyright it a super complicated thing, that’s why I have a copyright attorney I work with. Like my plush, dragons with fairy wings is not a new thing, nor did I come up with it, but my needle felted dragon with it’s style of wings and distinctive face is trademarked, so it the pattern which I designed so it’s copyrighted. If I had made a mold from a kirin & then made my scale then that would be breaking the copyright Windstone has. But my dragon is hand-sculpted and only 2.5″ tall. It’s sort of like dragons can only be made so many ways a head, 4 legs and wings, and scales (yeah I know dragons can have 6 legs and no wings if you want) but my point is a dragon a dragon, as feathers are feathers, scales are scales, etc. If I had sculpted feathers you could not say “hey be careful when copying Melody’s griffin feathers”

You see, I can’t copy scales from her if she didn’t come up with it in the first place. Again scales are scales, there are only so many ways of making them. Melody did not invent that scale pattern it’s found in fish and has been used in Japanese pottery for hundreds of years. It’s not her original design or anything & you can’t put a copyright on something like that. Now if I had made a Kirin with the same scales & painted it the same colors then yes that might fall under copying. But also my scales all come to a small point while the Kirin and Oriental dragons of Windstone are rounded. Hope that makes sense again I hate being accused of copying other artist.

I don’t see any problem. Those scales are generic enough and occur in nature. It’s only when pieces have a Windstone style or feel to them that it’s a problem.
thanks Nam that’s what I was thinking. Again scales are scales, I could see if I had glass eyes & style, paint job, etc…

Really, scales are just about the least copyrightable of all designs…because scales of all kinds are found in nature! 🙂 Particular and unique scale layouts, now that’s different…but scales are scales. It doesn’t even count as ‘copying’ because you’re trying to make a creature look realistic…best way to do it is draw from nature.

Thank you for that, great point! So true on the koi scales, I don’t see how anyone can say I’m copying anything when it’s something like scales. Now if I had made a Kirin with glass eyes in the same colors as windstone’s with those scales then yeah I could see that. Oh and actually it looks like Melody copied the scale design for both the Kirins and her Oriental dragons for traditional Asian dragon sculptures. I have a few very, very old (taking 100 year old) dragon pottery that has this same scale pattern. So I guess we both copy 😛

WTF I wasn’t in anyway trying to copy anything of hers never even thought about her kirins or their scales just sculpted a tiny dragon bust 🙄 Sorry I hate being accused of copying someone else’s work.

Oh that’s bad 🙁 my allergy is not that bad thankfully. I’ll look into man made fiber and see what I can come up with. There has to be something out there I would think. I’ve even done some needle felting out of pet hair (like clean dog fur) but it takes a ton & that normal only works for very small things. I’ll let you know what I come up with.

Thanks everyone! As for price they would start at $80. One just like this would be about $100 because the sparkly wool cost more & is harder to work with. Price is more than my normal 5″ dragons ($60) because this guy is a lot bigger 8″ tall and 10″ from nose to tip of tail. So size, special wool & wings are what make this one more.
Would you consider making one in something besides wool? I have that wool allergy. 😳 And then what would the price be?

Well how allergic are you to wool? I’m allergic too but the soft sculptures don’t bother me. Wool only bothers me if I’m wearing it or holding it too my body. As for another material other than wool I’m not sure what I could use. There are other wools like alpaca and merino wool that a lot of people are not allergic too. If you know what type of wool your allergic too I could just make sure not to use that one. The little one’s are $20 + shipping and about 3″ tall is standing and 2.5″ tall sitting down. I can make the little plush dragons in just about any color too!
