If only I did. I can’t even remember what year at the ren faire it was to look at old bank/credit card statements to try and puzzle out the shop name that way. And they were only selling the piece, I don’t think they made anything they sell.
*Does some thinking* The faire runs weekends until June 3. Maybe I can try and talk a friend into going with me to the faire and I can stop in the shop to talk to the proprieters.

This piece is a good example of one that may have been inspired by us but is an original sculpture that I don’t think infringes on our copyrights. If someone were to have a whole line of pieces that were inspired by us and buyers were consistantly confused in thinking they were buying a Windstone product it would be an infringement on our Trade Dress. That gets pretty hard to prove however. The fact that you guys questioned it shows just how strong and recognisable a look we have created.
May 8, 2007 at 12:31 am #566709I was at the GA ren faire this year and was in that shop. They had a bunch of gargoyles, and some looked like they may have been inspired by Windstones, but I didn’t see anything that came close to being an infringement. Mostly just lots of ‘cheap’ resin gargoyles. It seemed like many of them were also inspired by that newer line of black resin dragons that have come out. The ones they sell in Spencer’s Gifts, etc. They have that ‘gothic’ look.

I knew when I bought it and there were no markings for Windstone that is wasn’t an actual piece, but when I saw it sitting there I thought for a moment that it was one. I was just curious if it was an infringement of trade dress. Makes me feel a little better knowing it isn’t.
