Even if the damage is small, its still damage that should not have been there. The wrapping mess is inexcusable anyway, IMO, not when it took 5 HOURS to get off! That one thing alone is “item not as described” big time. Not unless the auction actually specified somewhere that “oh, BTW, when you buy this dragon, you’re going to have to spend at least one day cleaning it to make it look like the pictures”.

You’re absolutely right, of course :yes: . I appreciate the support. I will do what I can to get a refund, partial or full π .

Apparently. The dragon came from Nevada to. I’m sure what happened the package got really hot and melted the wrap onto the the dragon. I still can’t figure th logic in why she used it in the first place :shrug: .
I suspect that some people are just familiar enough with the mover’s wrap (green saran wrap available at uhaul, etc) to think of it as something to pack with, but not familiar enough to realise that it doesn’t mix with heat and with some surfaces. So they think saran wrap = bubble wrap without the air pockets or something. π

The packing saran type wrap is meant to be used to hold things together, like a sheets and pillowcases set, or to wrap around a drawer of art supplies so you can move the whole drawer without emptying it. I’m guessing some people just see that it’s a “packing supply” and assume that means it’s a form of padding?

It would keep the peices together when it shatters in shipping.

February 12, 2010 at 5:17 pm #805845Well – it appears my seller is getting itchy feet and want to file a claim with the post office. I managed to get some photos to her though of the damage caused by the wrap. Honestly, if it had just been the horn that was damaged – I would have let it slide. That is actually an easy repair. She warned me if she files a claim I may lose the dragon – and I don’t want to give it back to her after all of the freaking work I’ve put into him. I’ve explained I will be content with a partial refund – considering the bulk of the damage was – unintentionally of course – her fault. If she chooses not to, I still want to keep my emperor. Besides – I don’t think it’s very fair for me to but all this work into him only to have to give him back and have her put it back up on e-bay. We’ll see what happens. Hopefully she’s a reasonable person, and the photos will convince her I deserve at least a little compensation. Here are the pics I took of the most obvious damage. The first pic is of the residue left behind by the wrap on the wing.
This pic shows a big paint chip on his tummy that came of with the wrap and some more bits of residue..
This shows another paint chip caused by the wrap and some fragments of residue.
This show a ton of residue on his tail left behind from the wrap. Much of his body was covered in this crap that needed to be teased away gently with a toothpick.
In my opinion the damage is very obvious. Lets hope she feels the same. These are the exact photos I sent to her. Let me know what you think.February 12, 2010 at 9:04 pm #805846Honestly, if you file a claim with the post office you are going to loose. They are going to say that the dragon wasn’t packed properly in the first place and that they can’t be held responsible. That seller should just own up to it and give you a partial refund. You are being more than reasonable. If she saran wrapped him and didn’t give him any padding in the box that is all on her. The post office isn’t going to cough up a dime. I mean you can try it but it probably won’t work. Any money will just have to come from the seller herself. I’ve dealt with this a couple times so I have a little experience. Good luck though, I hope you get something back to get him fixed with.
February 13, 2010 at 12:45 am #805847Agreed. The post office will not give you anything if the fault was not theirs. They WILL refuse if the sender did not pack well enough. In my opinion (and this is just my opinion), I would ask for a partial refund and say you will get him fixed. This way, you get to keep the dragon.
So sorry, PT. It’s so unbelievably frustrating when you finally get a break, thinking you made a great purchase… only to find it causes more frustration. Sometimes, it’s just not worth it and it’s better to fork over the extra money. π
February 13, 2010 at 1:50 am #805848So sorry this happened to you PT–I think most of us here have received a broken piece or two because the seller didn’t pack correctly! I agree with getting a partial refund–again, that way you keep the dragon! I had to go through that headache myself! Frustrating when you are excited to receive a new piece only to have it arrive damaged!!! π
February 13, 2010 at 4:41 am #805849Whatever happens, I’m going to keep the dragon. I’m not going to file a claim with the PO because I know I’ll only end up having to give it back. I still haven’t gotten a response from the seller. I’m not to confident she’ll give me a partial refund, but we shall see. I’m not going to lose sleep over the matter, though. I know in principal I should be compensated, But lets face it – life doesn’t always work in your favor. Still, when all is said and done, I still have my first Emperor dragon π .

That’s exactly what I’m thinking. I got this item at a steal basically – and as mentioned before – I would have bought it in that condition for that price. I could make a claim with Pay Pal if she doesn’t refund me – but I really don’t want the hassle. In the end, if the buyer doesn’t want to compensate for the damage herself, I can live with that. I know that I was more than reasonable and fair with her . And in due time, I’ll make sure I leave feedback that are appropriate to her actions. I just want to enjoy my dragon – which I can as soon as I put this crummy BS behind me. I’m sure a lot of you guys are thinking I’m giving up, but I’m not. I honestly appreciate everybody’s support and suggestions, and I don’t want you to think I’m throwing your suggestions and support back at you . I love the fact that I have basically a Windstone support group when stuff like this happens. Everybody is so nice here, and I hope you can understand where I’m coming from.
In the end, as far as this issue is concerned, I want to be the better person. We all ‘win some’ and ‘lose some’ and as far as I’m concerned – I still won out in this situation.
