      Plus if you are responsible for getting the tenant out, you will have to pay all the legal fees.

      I agree. I don’t think it is right that they make you get the tenant out. You should make them do it. It could be a very messy situation and if the tenant did come back and try something they would take it out on you because they know where you live. It would be a pity to put all of your animals thru that espically if she follows thru with her threat and burns down the house.

        OKAY!!!! I JUST found outthe new offer had been accepted! Now it’s the home inspection once again (which should go well considering this is NOT a forclosure for once) and making sure we can get the financing for the extra money. Plus that damn tenant….They are going to give her notcie but are not obligated to get her out if she won’t go….*grumble*

        LOL! I bet if we get it, the next I will be telling all of you stories like in that movie Madhouse with all the people who WON’T LEAVE and make your life miserable, LOL!

          I think you should make it a stipulation of the contract for the house. ALL CURRENT TENANTS MUST BE VACATED. There’s legal stuff they can do if she won’t leave, like having the police remove her and changing the locks. Look into it before you sign the closing papers, or you’re going to be sorry you got that house. You think your mother is bad! Whew. Crazy tenants are worse.

            Yea I know. My sister and I discussed it and we feel we’ll deal with it if we absoultely have to. My boyfriends father is a statie anyway so if I have to take measures I will. The sellers said they wouldn’t sell us the house otherwise, which worries me. They have the same last names too so I think she is family of theirs which is weird. They will serve her a 30 day notice, but aren’t under any obligation to get her out by closing if she doesn’t leave…legally speaking.

            My sister works the bar alot at her restaraunt and we can get alot of hairy bikers down there for a big BBQ one day and spook her out if we must. LOL! I think that if we are just nice with her she will go on her own though. I just came back from talking with my mom ( I hate acting like I need her help )and she said she would rent her apartment to her if she wants it, so that way we can even give her a good lead to a new place.

            Still, I’m a bit leary about that too myself…but we want this house so bad dammit 😆 It’s HUGE!! and even though it’s ugly as sin on the inside (like original wallpaper from the 60s kind of ugly) It is fully updated with all the important stuff. Like roof, furnace, water tanks, vinyl siding, windows. Stuff like that. I’m not going to let this lady ruin it for us.

            We have to get an inspection witin 5 days and come up with another 2,000 between us for a down payment when we sign the P&S and then it should hopefully be all set for closing on May 15th! If this one falls through I think I’m going to give up and show up on Melody’s door step like a lost kitten and go live with the Emus. 😆

            Hahaha! Emus are fun!!! Sounds kinda fishy that the tenant has the same last name as the seller. They may be cousins or in-laws or something. That may be why she isn’t obligated to kick her out. Suspicious. Invite the bikers over and give her the lead on an apartment. Have a biker there when you talk with her to keep her on balance 😉 It’s possible she wasn’t paying rent for a while, so she may not be able to afford anything (hence why she is so adament about not getting kicked out). If she causes problems, go for a restraining order and have the staties deal with it. Local cops (if they are like the ones around here) won’t do anything if it involves paperwork, unless they absolutely have to.

              Inspectin went really well, and the inspector said we are gettin gthe house for a steal! 😛 Closing is May 15th if all goes to plan!

              Already hit one snag though. They just relisted the house we lost before this one and it was BEAUTIFUL and just got a 30,000 price drop. I’m convinced there is a REASON for that, but sis wants to drop this house and go after the other one now. I’m trying to convince her otherwise. *sigh*
              She whines worse then I do! If that’s possible! LOL

                  I had a thought, which was – if you own the property, and somebody else is on it, they’re tresspassing and/or squatting, right?

                  Tresspassing and squatting are illegal.

                  Can’t you call the cops on them?
