OK so here is the deal.
As a lot of you know I have been collecting Windstones for 20 years. I have been VERY concise on the ones I have been collecting.
I have 2 of the 23KT GOld Leaf Hatching Empress from the e-bay days.
I decided to try and get a White Hatching Empress. I found one here and to make a LONG story short I finally get her paid off and was anticipating her arrival. I paid $250 for her. I got her on Monday. As mentioned I’m looking to keep my collection MINT.
Well excluding Mama the Emperor Dragon i got from Kyrin. After opening the box I found out her left head horn is NOT Mint. It is broken and was no where in the plastic zip lock bag she was wrapped in. The bag was zipped so she never had it when I bought her.
I would like to at least get the $250 I spent to get her. All offers will be considered BUT I’m firm on at least in the ball park to sell her
Kyrin could have her fixed in no time but as mentioned I’m the Mint Freak here.
Other then the horn she is a BEAUTIFUL piece

Please PM me with any questions or offers

I’d be really upset myself…it will be really hard to sell her for what you bought her for with her damaged. Alot of people may not be mint freaks…but certainly wont pay mint price for a broken piece. Is there any way to get a partial refund for her, so you can sell her for the remaining amount…then you’d have your money back to put towards a truly mint white empress? I hope you’re able to find her a new home, I feel you were wronged when they didnt tell you about her damage. 🙁

I agree with Purplecat, it is an annoyance to me when sellers don’t disclose everything about a piece. Sometimes it is accidental, sometimes not. That is a good idea on the partial refund. I hope you can sell her.

If you were led to believe you were getting a mint condition sculpture, you should be returning it for the money paid; not trying to re-sell it.

Or is there there something that makes this not possible?

If agree with Dave. If you bought it being led to believe that it was mint, you should be getting your whole purchase price back…

The seller is not geting back to me to get this taken care of. I was sent pictures of her (if anyone want to see them I can forward them to you) and if you are a TRUE collector you can tell in this after picture that the horn is missing. I’m, not one to get her fixed and try to sell her for Mint that is not my style, but I do not want to be out $250 either
the seller is still insisting that she was mint when boxed even though there are no pieces loose in the ziploc bag she was in. I’m surprised due to the HORRIBLE packing job. I got a Hatching Empress and Mouse Wizard in White. The where in ziplock bags with one small sheet of the foam paper and some packing peanuts and that was it.
I’m NOT a happy camper needless to say

A very interesting piece of information has come to light about this seller . EXACTLY the same thing has happened to me with a white scratcher that I bought from the same seller – big chip , no pieces or plaster dust in the bag & the seller insisting there was no damage when it left her . I also bought the piece here on the forum . A bit TOO much of coincidence methinks 😕 .

This is not looking good. 😕 DM, I’m sure someone here can offer you advice about filing a claim through Paypal since the seller doesn’t want to work with you. I don’t know how; I hope you find out.

If you just got the piece on Monday, maybe give the seller another day or two to respond? Did you get a phone number? Maybe another member here can provide you additional contact information on this seller (since at least one other member did business with them).

If you still get no response back then have a friend help you open a dispute with Paypal (I’d offer to help, but I’ve never done it!). Or maybe a member can walk you through the process. It’ll cost you $25 to open a dispute, but $225 is still much better than getting zero back.

Anyways, I’m really sorry. I don’t see how anyone can claim damage in shipping if it was in a zipped plastic bag and there was no pieces or powder. 🙁

Not to butt in, but I had a similar situation before, but I don’t know if it was the same seller or not you’re both dealing with. It was a forum member who does sell on ebay, but it was quite a while ago and they don’t pop on too often these days…

First this is NOT a Forum member. It’s a friend of a Forum member. If I remember correctly the friends brother passed away and the seller inherited the pieces and did not want them so they where posted here, thru the friend. I only remember one picture of the Hatching Empress and it was VERY far away. The seller is still insisting that the pieces where mint even after sending me a group picture where if you are a collector with a trained eye you can tell that the left head horn was missing when that picture was taken. I can send you this picture via e-mail forward if you want to send me your e-mail address I can forward it to you. I’m not sure how to post it here.
The go between friend even told me to file a dispute thru PayPal BUT I’m not sure if that would work since I’m not sure if I have any proof anywhere saying they where MINT. You know buyer beware and all that stuff

The Forum member offered the phone number of the seller but even calling the person doesn’t seem like it would get anything done and I was asked NOT to say where I go the number from if I was to call??? How else would I get the number??.
I was hoping to rehome her here if there was someone that does not mind the repaired piece issue

I thought Paypal only covered E-bay transactions that go wrong .

I just looked, and in the Resolution Center of Paypal they give you 45 days to open a dispute, and one of the reasons for opening a dispute is “Item significantly not as described”. It said nothing about being for Ebay only transactions.
