Hey, I’m not the boss around here! 😀 I’m just curious about the seller’s new old name. She has a feedback of 66 suddenly. It’s very confusing.

The problem with Photobucket and Deviantart (and the reason they don’t want Windstone images on those particular sites) is that Photobucket allows ANYONE to purchase prints of the images you upload there. The chance that someone would buy a print of a photo of your Windstone is pretty low, but the potential exists and that is not allowed. It’s a little complicated.
Deviantart is shied away from (you’ll notice Melody doesn’t have her work posted on there) is because their TOS and artist agreement is worded in such a way that some rights are relinquished to Deviantart for use of the image. Windstone can’t allow their product images to be used by third parties. The chance that Deciantart would DO this is remote to nil, but because the contract is LEGALLY worded in such a way, they don’t want their images on there. I know this has been a big debate amongst the Deviantart community, but it is what it is.I think spreading the word about Windstone and PYOs is a good thing, but as we already know from the few auction troubles we’ve had so far, it can lead to problems. I think the key is to pay close attention to the contract/TOS/user agreement when EVER you upload an image to a host that is not yours, and if it relinquishes the rights then it’s best to shy away from. It’s also important to be clear on what it is people are seeing; if you want to be really careful just put some simple text on the image to the effect of “Copyright © Windstone Editions/Melody Pena, painted by Your Name”. That way people know what they’re seeing and can appreciate that you did a beautiful paint job on a Windstone- and should they desire one can easily google “Windstone” and find out what it’s about. 🙂
John is out of town right now but I’ll see if I can ask him for a clarification on the gold trim part. I don’t know what that means exactly either (I suspect that it means ‘when used in conjunction with {windstone-like colors]’ but I’m not sure). I’ll see if I can get some sort of answer for you guys since that seems like the biggest issue at hand, right?
John and Melody had some very real concerns when they were considering producing the PYO line. MElody herself told me that she hoped this wasn’t a huge legal mistake. They knew it would open up a whole new world of legal issues because then their product and look would be much harder to protect once folks started putting their own colors on them. However I don’t think anyone should panic or get up in arms; of course Windstone wants to protect themselves and their livelihood, but at the same time the whole reason they came out with this line was so that we could have fun with them, enjoy ourselves, and be creative. These products are really just ‘for us’! It’ll just take some patience to get through these initial snags (the product is less than a year ‘old’ from it’s initial release!). Problems that weren’t even considered before are the ones that are popping up and making everyone stop to scratch their heads. 🙂

She feels terrible about some of the things said about her on this forum and has beena collector of Windstones since she was a little girl. She had nothing but good intentions and has the highest respect for Melody as we all do. I know some of you out there have painted your PYOs to match your collection. She just took the next step to sell one which she was just unaware of insanity it would cause. True, she was kind of pushy with the whole “sercet keeper” mentioned over and over, but I’m sure she was trying to garner everyones attention to how it would match a production Windstone.
I don’t know, I mean, I’m not defending her actions in selling it. I know it was wrong, but at the same time I do feel for her situation. She doesn’t even want to join the forum now because of the whole issue. It’s very sad.

Obviously she really loves Windstones so she should be a member. Everyone makes mistakes and I don’t think anyone would hold it against her. Especially if she originally painted it for her collection then had to sell it. She’s very talented – many people (including myself) mentioned how beautiful the dragon was. It would be great to see other PYOs by her.
January 23, 2007 at 7:56 pm #528329I think she is an awesome painter and if she is aware of her mistake and wont do it again, thats all I ask. I think her Ebay name was a bit much, but if you say she is nice, then she is nice. 🙂 If she was not a member of the forum and didnt read the topic where we talked about copying, then she would not know its not allowed. I kinda think it should be allowed, since its a Windstone. I know there was a valid reason why we couldnt, but I dont recall what it was.

January 23, 2007 at 8:16 pm #528331I asked her to join up also, and I think she will, but she may be kinda afraid of lashback for what happened. She really didn’t mean to cause a stir and right now she’s just very nervous and just wants to make others happy and paint PYOs because she loves Windstone, but is afraid of what people may think of her now.

The issue isn’t that bad- I am sure they have no problem with her as a person! After all John himself said that they want to help educate folks about this. I doubt anyone is mad at her. 🙂 Heck I think more people were angry with Nirvanacat before she came here and now we love her! 😆

My art: featherdust.comJanuary 23, 2007 at 8:40 pm #528336As I said before, I believe that the PYO painted by Windstoneeditioncreations would have sold well without all of the keeper references, etc. It certainly is a beautiful dragon and I would have bid on it myself, except for all of the other issues. Everyone makes mistakes, myself included and we all seem to forgive and forget, as it were. Please tell her she is welcome here and to excuse our remarks, if she found them offensive. We are very protective of Melody – what can we say? 😉
