Be careful with the “he said she said” drgnlvr- be respectful. 🙂 I suggested you come for advice in how to try and recover the dragons or the money, since I have not had experience with FedEx I was hoping some other members might be.
Everyone is okay so far but I will issue a warning now- keep it to facts. Lets focus on if we can help either party recover the dragons– and if this turns into an argument between the two involved I will be swift to lock this and warn those involved– as I have tried to smooth things out in private and you have both been warned.
This might just be an expensive lesson learned. Items are regularly simply ‘left’ on my porch without even ringing the bell, and I have genuinely have had things stolen off my porch before.

I am trying to see this situation in all lights. I know I’d be pretty upset if I was shopping, put a bunch of things in my shopping cart with intent to purchase, but then for some reason (perhaps upon checking my bank I didn’t have enough money) I didn’t click “Purchase”- and then the items showed up at my door with a bill.. I wouldn’t be happy.
More than anything, lets try to figure out where the dragons ended up.

When we contacted FedEx they offered to track down the driver and find out from him where it was delivered. It turned up at our door two weeks later. I don’t know it it will help in your situation but sometimes a phone call to a live person can make a difference.
On the other hand if they confirm that it was delivered and the driver just left it on the porch than FedEx should be held liable (good luck) If someone had time to take two good sized boxes they might also have sense enough to take the tag to cover their tracks.April 29, 2008 at 4:37 pm #694226khat7 wrote:We had a package from FedEx delivered to the wrong address before. I had a FedEx delivery of a huge prints order I had placed (over $300) and they delivered it to someone in the other end of town. The person that got my prints was amazingly nice and called me to let me know he had my package. I was so happy that he was nice enough to call but still angry at FedEx, as the tracking number said it was delivered to my address! I did issue a complaint, fat lot of good it did.
Additionally on my birthday once, our fedex guy delivered live flowers… by throwing them in the bae of the driveway and not ringing the bell in early February! Needless to say I didn’t know they arrived and they died outside. The flower company, though they didn’t have to, sent new ones and the same thing happened (but at least I knew they were coming so I got them before the cold killed them).

What you do is exactly what you would do if you had got payment, shipped the packages, and the packages were not received by the buyer.
The first thing you do is file a claim with FedEx: you shipped an insured package and the addressee has not received it. It does not matter at all that FedEx shows the packages were delivered.
FedEx has better resources than you to determine what could happen to a package. If the boxes were left at the destination without being signed for, the risk is on FedEx’s part, not yours. Unless you signed a waiver of signature (I hope you did not do that).
If the addressee has not received the shipment, they will have to sign a legal declaration to that effect with FedEx. FedEx should then pay you on the insurance.
It is entirely possible that the packages WERE stolen. This happens. I have customers where I enter on the shipping label “Do not leave package unattended” because they don’t trust their neighbourhood.
But really, from your point of view, it is moot. What you do does not depend on believing or disbelieving Dragonscavern.

Fortunately it was just next door but one was a gift and the sender was upset/hurt I hadn’t called to thank her. She had checked and the package had been delivered but I never got it. Fedex swore up and down they had delivered it. I’ve had similar problems before so I went to check – turned out the driver had put both packages UNDER the steps of the small porch next door and you could only see them if you approached from the side. So they weren’t stolen but they were out in the weather, more or less, for several days in winter!
And just today Fedex left a package that was signature only leaning on my steps (inspite of the fact that I have an enclosed porch). By leaving it they saved me a trip to go get it (third attempt) but it would have been a disaster if someone had stolen it!
So I would definitely talk to Fedex again.

I did call the FedEx office and they faxed me the claim forms, I filled them out and faxed them back, so I’ll see what happens next. I want to say it was not my intent to make anyone look bad, (including me) I just did not know what to do, that’s why it took me so long to ask for help. If I had known I could file a missing box report, I would have done that much sooner rather than make a fuss on the forum! So thank you, Dave, and thanks to all the rest of you for being there. You are terrific!! 😀
