Well, she was wearing scrubs when I hit her so I’m worried she can probably get falsified medical paperwork if she wanted to.
My insurance company paid out something like $347 to her for the minor scratches in her paint.
She didn’t go to the hospital and was completely fine on scene. She threatened me she was gonna sue me and was so in my face during the aftermath of the accident that the cops made her go and sit down in her car to keep the peace.

Obviously no injuries to her lungs, then. 😐
Possibly the police report might be useful to you here: if the officer on site made a note that the other woman was belligerent, it makes her look awfully suspect if she pursues a lawsuit. I don’t know enough about legal stuff to advise, unfortunately, but I think you might be allowed a copy of the police report. Certainly a copy of that report should be going to your insurance company, and hopefully they will go to bat for you.I’d recommend talking to your insurance agent: find out what you can do to protect yourself, and how far they are willing to go to protect you.
As for the fact that the woman wore scrubs: she may not have any connections to the medical field. She could be a dental hygienist, or a kennel assistant, or a dog groomer. If she procures “medical records,” definitely have them checked for veracity. They may turn out to have been signed by I.R. Baboon, or Dr. Inever Sawrbefore.
Oh that sucks! And I thought my year was off to a bad start.

I didn’t mention my Windstones…but I’m wondering if I should sign them over to my sister or something for safe keeping
Now I’m worried! If I was sued by this lady, and I have no money in my bank account, just a reasonable income, (nothing worth suing for) and I don’t really own my truck because it is financed so that’s not an asset… the only thing I have worth anything are my Windstones and I guess my DVD collection. Do you think if I was sued by this woman and I didn’t have any money they could take them instead, or force me to sell them??

Neither, I don’t have them insured. I have thought about but never have. Also, I haven’t really talked to anyone about it yet. I just sort of thought of it when the word “asset” came up.

Also sending you additional info regarding the garage repairs to the truck in case that hasn’t been taken care of (they should not have come back to you for more money… it should have been agreed upon regarding what was repaired and what was paid by insurance between the garage, the adjustor, and the insurance company). If they are coming to you directly, they are trying to get more and that can be easily considered extortion. Get the insurance company and adjustor on the phone.

Not sure if this would still apply but first of all, if someone was seriously injured in a car accident, liability insurance would cover any medical expenses but because she didn’t even go see a doctor and was obviously fine after the accident, she has no proof of any medical issues and could get get in very big trouble for falsifying anything in court. If she was already paid for car damage by the insurance company but nothing for injury, she has nothing to sue you with, no evidence and especially the minimal damage on her car, would be laughed out of a courtroom. Now for her to even file a small claim, I don’t know where you live but it costs us $200 to do that here and for her to hire a lawyer which could be a lot more, she would be laughed at if they have no evidence against you of any injury. No lawyer would even take a small claim case like that.
If by any chance she took you to court or won anything which she wouldn’t, they would simply file a judgement against your name. This means very little as most people never even pay off a small judgement which is basically a paper sitting at the court house with your name saying you owe someone something. And even if you did have a judgement on file you can fight or appeal it. I know as I have been involved in many legal battles in small claims court over problems when my house went through foreclosure and bad landlords trying to file claims for rent though never returning damage deposits, etc. I have seen people fighting for every kind of case you can imagine and most cases are simply dismissed without proper evidence.
Secondly, if anyone asks you about your assets, you have none. If you have to, write a bill of sale to your sister for any random made up value for your Windstones that is low as no one would know the difference. People can even hand write a bill of sale for a car for $1 if they want to and it’s still considered legal. Although once this is all over with, rip it up and I would suggest if you don’t already have your Windstones covered under your house insurance, to get contents insurance if they are worth a lot in case you ever have house problems again where they could be destroyed or even stolen.
I don’t think in a case like this you would have to spend any money on a lawyer. Sounds like this lady is crazy or full of hot air and threatening to sue people is pretty common if people are angry until they calm down and realize they have no chance of ever winning anything against you. I have been to court, had judgement filed against me and never had to pay out anything or sell anything as I simply filed my own counter claims and judgments against the same people until everything was dropped.

The garage did collect another $2000+ in additional damage from my insurance company once they took it all apart and found extra stuff to charge for. The adjustor stated some of the body damage was “pre existing” (which of course it wasn’t) but they didn’t consider the door damage since it was a rear ending. I tried to explain the fender was pushed into my door which caused the additinal damage there, but they basically said if I wanted it fixed I would have to file a seperate claim, pay an additinal deductible, and probably face an additinal surcharge, so I’m just paying out of pocket to fix the rest to avoid all that. $1400 total out of pocket instead of $500 which was my deductible.
I did get a police report already and faxed it to my insurance company AND mailed it. The officer who was there actually knows Shaun from him being WalMart security and once she knew I was his girlfriend, she did write it in a manner as though, even though it was my fault, the woman was uncontrolably angry and made threats to me and they had to send her away. She also refused medical treatment. So at least the police were on my side even though, the accident was clearly my fault.

Thanks everyone. I am supposed to go and get my truck from the repair shop tomorrow morning. I haven’t seen it yet. I am crossing my fingers it looks good and runs just as well, but I had a dream last night it was a complete disaster! Like two tones in color (totally off) and that when I started it up black smoke started pouring out from under the hood >_< So tomorrow I am off to drain my bank account and take care of that, but at least it will be done.
I've been having a lot of really screwed up dreams! Not all nightmarish per say, just messed up! Like also, last night, I had another dream I was at work and I got a call from my manager that a customer wanted to sue me because I sold her a faulty appliance and it flooded her house and then a giant skunk colored fisher cat looking creature ran up to me and started chasing me and springing up to my face trying to bite me! It had a pink bow by one ear like it was an adorable BUT terrifying pet at one point! One second AWE SO CUTE! and a millisecond later a rabies infested giant ferret with skunk stripes and giant razor teeth. 0.o I was running around the store screaming and I woke up right before it was gonna gnaw my face off!
