      I don’t think that statement is correct (as I couldn’t find anything on the internet that supported it). Just because something is a rodent doesn’t mean it can’t be a “pet”. Wikipedia listed these rodents: guinea pigs, fancy mice, gerbils, fancy rats & hamsters, in their list of “pets” along with cats, dogs, etc. And fancy rats are domesticated, so I don’t see the comparison between them and a flea or monkey.

      For the monkey/flea thing (which I deleted right after posting it in case someone took offense to it) my point was that the landlord does not have to list every animal the tenant CANT have, only what they CAN, but since there is no lease agreement (a silly move in itself because of situations like this and one that could get a lot worse should said ‘landlord’ decide to kick this girl out) its a moot point. The landlord can do whatever she wants. Should she decide to call the cops and say Dragon is tresspassing and have her removed, she can. Rats, if they are considered ‘pets’ at all, would be considered ‘exotic’ anyway and not allowed by most landlords. Maybe the ‘pets’ thing varies state by state. Here in Hawaii my rabbit was considered livestock and not a ‘pet’. :shrug:

If its her house and there is no form of written agreement, then she can pretty much dictate what she wants… including no rodents in the house and kicking you out without notice. If you are paying rent, I would ask for a contract, quick, just to protect yourself. Im sorry she wont let you keep the rats. They get a bad rap.

        That’s not exactly correct from what I understand from the laws I’ve been reading…..If she entered into an oral agreement to pay a monthly fee to live there and has been paying her rent on time for longer than I think 2 months? (I am probably wrong on the time frame) then she is indeed engaged in a legaly binding oral contract, and both tennant and landlord must abide by general tennant/landlord laws in the applicable state. The landlady must abide by the state eviction laws at this point. Also if she has prepaid for any rent, the landlady is going to have a hell of a time evicting her at all, at least untill there is a TON of paperwork filed. But because there is no written contract, then the particulars of the contract are heresay if brought up in court unless both parties agree that a term was indeed stated. Like “you can’t have pets”…”I understand you don’t allow pets” when there is no dispute, then the rule must be abided by.

        Either way I think that you and she should sit down together and write up a formal contract, there is a sample one provided on one of the sites listed above. That way everything is layed out on the table and there are no more “surprises”.

        A couple questions for my clarification: Did she know you had pets before you moved in? not neccesarily rodents, but pets in general. Do any of the other tennants have pets? Did she say ANYTHING before you moved in about not having pets, or only alowing certain pets? I’m sure you’ve tried to talk to her about it, but someone had the idea to invite her in for an inspection of the place and show her how they are in a secure environment and not making a mess/nusance and that they’re not the “bad” kind of rats. Also try and get ther side of the story, ask (in a non confrontational tone of course =P) how she came to hate rats with so much of a passion. Some times people just need to have their side of the story heard before they can listen to someone else’s story.

        I know we’re probably making a bigger deal of this than needs to be made, but I for one find tort and contract law facinating and this has given me an opportunity to do more research and become a much more informed person, both from the research and everyone else’s ideas and suggestions!

          Must be a state or regional thing (or even just a Hawaii thing 😕 ) because I’ve never heard domesticated rodents or rabbits referred to as anything else but “pets” in New England. And rabbits, ferrets, domesticated rodents, etc. are sold in Pet stores here, so I’d be curious how a landlord could argue them being anything but. Even if labeled “exotic” pets, they are still pets. Again, maybe not in Hawaii; I have no idea what they sell in pet stores there. And the “most landlords” statement must be from your experience, as I’ve encountered a lot of prejudice against rats, yes, but not an exclusion of “exotics” as a whole among most pet friendly landlords. I guess another reason to be thankful I live in this region instead of anywhere else.

          Anyways, I appreciate all your effort with the links, Nirvanacat13. Even if it wasn’t directed for me, I’m reading up because my brother and his gf don’t have a lease on their apartment (and have plenty of pets, including rodents and non-rodents). It’s nice to know what their rights are if ever their was a problem.

            Once you get mail you are a resident and can’t be kicked out for trespassing…

            It’s so hard to know what to do. I’d rather keep them but I just don’t want to have a moody landlord complaining about it and keeping bad relations with her, because I may be here for at least another 2-3 years. I want to thank you nice people for mentioning goosemoose. I registered and posted and have one person already interested, I need to get further details but I could be looking at a 4 1/2 hr drive to get there as they were talking about Orinskany (sp?) Falls in NY. I looked that up in Google and the drive is quite long from where I am in NJ. I’m hoping we can maybe work out a middle meeting place. I’ll drive 3 hours tops for a “day trip” but anything more has to be like for at least a weekend! LOL I have plans to go horseback riding this weekend so I’m not sure how this will work out.
            But these people are rattie lovers and they’d be the best kind to take them!
            I’ll keep you all updated and thanks much for your advice and opinions.

              Aye, I hope everything works out for you and your babies too! I understand the decision to just make things easier between you and the landlady, and would still suggest sitting down and talking with her about her side of the issue. She may see you as a more valuable tennant that way instead of someone she knows she can get to do something by complaining enough. (hope that made sense) Anyway I wish you all the best and send big hugs!

                  Im glad that you have a potential owner for the rats. Thats some good news.

                  Lokie, its not just Hawaii. Almost anywhere in the US, anything besides a dog, cat, or horse… I think there is one other animal there… maybe fish?… are considered ‘exotic.’ They are still sold in pet stores everywhere, but even a hampster, arguably the most common pet beyond a dog or a cat, is still considered exotic. Its kinda silly considering how common they are. 😕 But yeah… my bunny was livestock and not allowed in my house.

                    I understand letting your boys go will be a difficult decision, Dragons4Life, and I know you’ll do what you think is best for them as well as yourself. If you can keep them, great, and if you need to rehome them, then I hope this NY home works out. And even if it doesn’t, hopefully another comes along. Those goosemoose members are rat fanatics, so feel confident knowing they will go to a loving home! And thanks for the updates, I definitely would like to know how this all ends 🙂

                    And Ski, I’m very aware that rodents and rabbits and such are classified as “exotics”. That’s why my rabbit and rats go to an Exotic Certified Vet (who charges me an arm and a leg) >.< My point in quoting you was two things: 1. "Exotics" is an adjective in this situation not a noun that replaces "pet". So even if she has a rat or a dog, they are both "pets" and are treated as such equally. Maybe not in Hawaii, but in NJ, yes. 2. Was to point out that it must be a state/regional thing that "most landlords" won't allow "exotics" (as an umbrella term for all exotics), because I've NEVER heard a pet friendly landlord say "no exotics". They might not allow certain exotic pets (at the landlords discretion), like for example, no rats, no ferrets, no etc, or I'll say I have this or that and they say yes/no. But never excluded every exotic pet. Actually, there are quite a lot of exotics landlords welcome here (as you pointed out, the term exotics encompasses a large variety of pets). Sometimes it's getting an apartment that allows a dog (because of noise and destruction) or a cat (smell) that can be the difficult task. I say this as someone with rats, a rabbit, a chinchilla, and dog and understands how tough it's going to be to find a new landlord who accepts them all. 🙁 Man, this quoting thing went from rodents aren't pets to exotics definition to what landlords allow. You never know what your going to read when you click the thread 😉 Typical Windstone forum 🙂

                        All I can say is that when Louis and I actualy get kicked out to live on our own, we NEED to find a place that’s comfortable with us having lizzards and snakes and a dog LoL 😀 😀

                          I thought us rat owners had it tough; I think the only legal pet (that comes to mind…) that gives the rat a run for it’s money, negative reputation wise, is the snake. Not that movies like Snakes on a Plane is helping to alleviate any fears. You might need to get creative with a child’s Halloween animal costume and try to pass it off as a pot bellied pig =P

                            Pffffttt….that snake is a moo cow in her own right…Put some stick-on legs on her and she’d pass for a pot bellied pig no problem…..She’s gone a long way from the emaciated rescue that weighed as much as a curlie when we got her, to this big fat cow that weighs at LEAST as much as a Mother Griffin…..No, we don’t take care of our reptiles at all….*snort*….*sarcasm* LoL
