April 13, 2009 at 2:36 am #759461In the end with my busted Windstone, even if the seller hadn’t rudely demanded I send him back or I wouldn’t get a cent back, I decided I didn’t want to keep him anyway because every time I looked at him, I remembered how annoyed I was at the whole situation.

I agree. The paint scuffs are not a big deal (easily fixable) but that horn is a mess and not really fixable 🙁 . Besides, the seller needs to be taught a lesson, namely – how to properly pack Windstones 😡 . Some sellers, what the heck are they thinking?

I see what you mean now, Sunhawk, now when I see him I just think of what an ordeal this has been! I’m still waiting to hear back from her after sending her the pics (ie PROOF) of the damage. I’m hoping the delay is because she’s having a lovely Easter and not because she plans to avoid me.
Anyone had any experience with the time limits for disputes like this? She’s dragging this out so much I’m worried I won’t be able to get my refund simply because too much time has passed.
April 13, 2009 at 8:23 pm #759464There are time limits, but check with paypal to see when they apply. I don’t know if they start when you first got it, or after your last contact with her, but I wouldn’t wait too much longer. You can always file the dispute and then you have I think 45 days to escalate it to a claim, but I’m not absolutely sure of that, but it’s somewhere in that range. Paypal will take over from there, contact her, if she doesn’t respond, they will find in your favor, they will pay you up to $200 and they will go after her, in the meantime, unless she demands the kirin, you can keep him. But check with paypal to be sure of the time frames. I think you are wise not to pursue her anymore, filing a dispute/claim will resolve the matter. Be sure to tell paypal everything you have done to try to resolve this with the seller, and give them the whole history from the beginning. Keep in touch! :yes:

Only problem is, if this is the person I think it is, then she will probably keep your money and say you never returned the item. Something else she might say is that this was not the same one she sent and the one she sent was in much better condition. Bottom line, you would not get your money back. I think this girl shafted GB before she joined the forum and shafted several people after.
April 14, 2009 at 12:01 am #759466If you decide to send it back make sure you have delivery confermation on it and save all the pictures of the auctions and the actual one you received. Even if she says it’s not the one she sent you can still fight it with payapl. Sudmit all the info emails and pictures to paypal and they will help.
If you paid by paypal:
“Step 1 – Open dispute right away
You can open a dispute in the Resolution Center to contact a seller directly and resolve a problematic transaction. You have 45 days from the payment date to open a dispute. Common reasons for opening a dispute include:
– You paid for an item but haven’t received it and the seller is uncooperative or nonresponsive.
– You received an item that was significantly different than described.Click the Report a Problem button in the Resolution Center to open a dispute. Then, provide more information about the issue and post a message to the seller.
You must wait 7 days to allow for shipping before opening a dispute for an item not received. Transactions older than 45 days cannot be disputed, but should still be reported. PayPal tracks seller performance trends in the event we need to take action to protect other buyers.
Step 2 – Negotiate to resolve dispute
You and the seller have 20 days to resolve the dispute or escalate it to a PayPal claim.
The seller reviews your message and replies in the Resolution Center. This is your opportunity to communicate directly and resolve the issue by exchanging message posts. Communicate clearly and include suggestions about how to resolve the issue, such as through a full or partial refund.
PayPal can view all posted messages in case the dispute is escalated to a claim.
We place a hold on all funds related to the transaction until the dispute is resolved or closed.
Step 3 – Close the dispute or escalate to a claim
You can close a dispute if you and the seller reach an agreement.
Otherwise, you can escalate the dispute to a PayPal claim within 20 days of opening the dispute. We automatically close disputes after 20 days.
Wait until you are 100% satisfied with the resolution before closing a dispute. A closed dispute cannot be reopened or escalated to a PayPal claim.
Select the open dispute in the Resolution Center and click the desired action at the bottom of the dispute details screen to close or escalate a dispute.
We require more information from you when you escalate a dispute to a PayPal claim.
Step 4 – We investigate and resolve the claim
By escalating a dispute to a claim, you are asking PayPal to review it and decide the outcome.
We try to resolve cases within 30 days, but complex cases may take longer to investigate, deliver a final decision, release any funds, and close the case.
You and the seller may be subject to specific deadlines for new information. We use the messages exchanged in the Resolution Center, along with other details, to determine the outcome.
You can track the progress of your claim and respond to requests for information in the Resolution Center.
We notify you when we come to a final decision.
For eBay feedback:
Feedback can be left for at least 60 days following a transaction (the date you won the item not the date of payment). I hope your seller doesn’t do what mine did and claim that *I* broke it after I sent the proof of breakage pics, that was also fun. How many days has it been since you paid for the auction?

April 16, 2009 at 4:08 am #759469You don’t have to wait until the deadline, y’know. You can give the seller a “reasonable” time to respond, like a week from the last contact, and if you don’t hear, or she sends another email that is less than wonderful,(like a full refund!!) you can file right away and get the process started quicker. It isn’t that hard and paypal is very helpful.
April 17, 2009 at 2:05 am #759470Thanks Drgnlver. I sent her all the damage photos a week ago and still haven’t heard back (she usually takes 2 days tops)….sooooo I sent her a “friendly” e-mail asking, hey, I haven’t heard from you, did you receive the photos?
No answer.
She has two days to respond and then I file. Enough of this crap!

You can only delete a post if it is the very last one in a thread. To do so click the little box that looks like an x next to the edit button. It will ask if you want to delete the post. Confirm yes and then it’s gone.
