Paypal User Agreement:
4.4 Risk of Reversals, Chargebacks and Claims. When you receive a payment, you are liable to PayPal for the full amount of the payment plus any Fees if the payment is later invalidated for any reason. This means that you will be responsible for the amount of the payment, plus the applicable Fees listed in section 8 of this Agreement if you lose a Claim or Chargeback, or if there is a Reversal of the payment. You agree to allow PayPal to recover any amounts due to PayPal by debiting your Balance. If there are insufficient funds in your Balance to cover your liability, you agree to reimburse PayPal through other means. If the transaction is eligible under the Seller Protection Policy in section 11, PayPal will cover the amount of the Reversal or Chargeback and waive the Chargeback Fee, if applicable.
Here is the web page too, there are some interesting things in there that people should read but don’t….I agree with Emerald, if you’re an honest seller, there should never be a serious problem….Hiccoughs here and there *like silly impatient people* but no lasting issues.

That’s interesting…it seems to imply that Paypal can recover the money owed by debiting from the linked bank account or charging the linked credit card without permission.I think in most cases people won’t have a problem with Paypal, but I’ve read some horror stories about them…see items 4 and 5 on that webpage…

So, the ramblings begin…..
I won a set of wizards back in Feb. which was really nice, a White, a Peacock, one of the old Black and Reds, and one of the old Blue and Reds, all supposedly mint condition with original boxes. Communication with the seller was going great, got an AWESOME price on them, all four for just over $500. And about a week ago I had to file my first ever escalated claim into paypal…..I’d sent about 6-7 e-mails to the guy asking what was going on, if he was ok, where was my stuff…..I have a tracking number, but it was one of those where they had done it on paypal, and so the PO was “expecting” delivery of the package, but no info beyond that. Well, it’s been over a month since the package should have been sent, and I stopped recieving e-mails from the guy. Thus the claim. If he doesn’t respond to Paypal by 04/12/07 I win by forefit and get my money back. But such a bummer none the less. I really would have liked those wizards, and have passed up other auctions in anticipation….Meh, such as things go!
Ok enough of the ramblings for now. I just figgured since it had my name on it, I’d post mercylessly! Muahahahahaha!
I remember that auction! That was a good deal too, bummer Nirvana. At least you will get a refund, but the wizards probably would have been better

April 10, 2007 at 7:44 am #560195If you have direct deposit from your employer, they can go into your account to recover any amount they have over paid you. It’s listed in the fine print when you sign up for DD. Having worked in a bank for a while, it’s been interesting watching all this.

Dang! Yet another narrow escape… I was telling my bf about these and what a great buy they would be, but I ended up not getting them for some odd reason.. probably the $500 price tag. I am very sorry you are having a bad deal. What crap. Those wizards were sweet!

April 10, 2007 at 4:27 pm #560200Ahhhh the drama and intrigue continues….Remember all those White dragons that went up? Well after a hectic week I finaly got “descent” pictures of all the minor damages. Nothing was really huge *except the 1/4 inch chip out of the Empress’s wing* Mostly rubs and minor chipping…but still, I payed a LOT of money for them because they were supposedly MINT condition with original boxes. This fact alone is worth more to me. But alas, only 3 of the 6 came with original boxes, and the scratcher only had half of the cardboard packing.
The damages totaled to this:
Scratcher: 4 of his little side nubs along the arm and shoulder were rubbed almost flat, he had a really nice set of long rubs on his wing crest? on the left side as you look at him, and some rubbing across the top of the nose.
Male Coil: The VERY tip of his tail was crushed…a space about the size of pinhead, but just crushed.
Young: Prominent rubs on the top of his two bigger head spines. Rub down to the gypsum on the top of the curl of his tail.
Kinglet: Looks like the very tip of his nose got chipped off, about 3mm round and a rub on the side of his nostril.
Emperor: 3 places on the head crest where the paint was scraped down to the gypsum. One very small rub on the right (as you look at his face) “ear”. Three slightly larger rubs on the left “ear”.
Empress: 1/4 inch chip on a spine tip of the wing (looks like it took off the pointed part) Some minor paint rubs to her left (as you look at her face) “ear”. Also looks like she tried to eat out of the thin cardboard box she was sent in.
Anyway so I sent the pictures off to the guy night before last and still haven’t heard a peep from him. I haven’t heard from him since I actualy told him the what the damage was. The last time he sent me a message was when I first wrote him in a migraine induced stupor telling him the packaging reeked of smoke. I’m really not sure what to do on this. I mean the damages are minimal, but I dropped….A LOT….of money for these to be MIB that I would not have otherwise spent. I’m so sick about the whole thing…
Anyway, I’m really sorry to be a drag and post all my problems at once, it’s not that big of a deal in the scheme of things, and I’m sure there are some of you thinking “It’s about time she got a run of bad luck” *I know most of you wouldn’t, and it doesn’t matter if anyone does think that, but while I’m in the doldrums I feel a bit of self loathing is in order* Not really looking for sympathy at all, but you guys are really good about constructive criticism so I thought I’d throw it all out there. Let everyone know that I’m not completely the big bad a$$ I pretend to be =P.
So the open ended question is: Am I just being too picky, or should I at least try and collect some of my $1275 back? Also did anyone else on this forum get the other pieces from snease_axis? They would include the White Emperor, Male, Young, and Mother and Hatching. I’d like to know how they fared and your dealings with the seller if someone is willing to post.

April 10, 2007 at 4:44 pm #560202Uppon going back and looking at his feedback looks like everyone else got their dragons ok…..It was the Fledgling that was the other auction, not the Young…*sheesh I got the young…*
The pluses to this guy is that he shipped immediately after payment, was very friendly and responsive *prior to there being a problem* he payed for the shipping, and I think he genuinely thought these pieces were in mint condition and had the original boxes…..I don’t know…….
April 10, 2007 at 4:54 pm #560203I agree with Nessie – you should get some of your money back. I picked one of the auctions at random and he says at least 3 times that the piece in question is mint.
You’re not the only one this has happened to. One of my pieces that was supposedly mint came with two chips, right down to the gypsum: -( This was from a different seller, but this seller has gotten all great reviews from Forum members. I kept the piece, ’cause I can fix it. Some people just don’t say anything (for whatever reason). I guess we all have bad luck and I don’t think any of us “deserve” it.
I hope the seller is cooperative!
April 10, 2007 at 4:55 pm #560204How can you not tell there are places worn down to the gypsum? I can understand paint scuffs, to some degree, but even on the whites I’d presume there is an obvious difference between gypsum and the paint… (I don’t collect the whites, so I don’t know for sure about that one!) I still think that I wouldn’t advertise MIB unless I had gone over things with a magnifying glass to make sure I wasn’t advertising in error, but maybe that’s just me… But I also know that some of you guys can pick up on things that I can’t see from the pics…But then again, I don’t have the world’s best vision, even with glasses…(and that includes the bifocals!!)
