Pretty rude of the seller not to respond, and posting a pic that’s not of the actual item being sold is a bad idea anyway. You did rightly, BDW.

“Due to a technical reason, I need to end this listing early and relist the item. The new item has a photo of the actual piece. The number for the new listing is: 130355727770.”
I’d asked if the photo on the original auction were of the actual piece and that I was confused because one kitty had a blue stone in it’s collar and the other had purple.

January 2, 2010 at 6:57 pm #797825Glad it was removed. Funny that I got an email from the seller only after I sent the fax to eBay. Totaly ignored me till then.
Sent me this message:
“Hi, my apologies. Since the photo had copyright information on it and I did not claim to have taken it, I did not think it would be a problem. I will remove it asap.”
And then this:
“I am sorry- I am trying to remove the image, but having a problem finding the correct option. Even though I uploaded a new image, I cannot find a way to replace or delete the initial image, or set it as secondary. I will email ebay about the problem, and unlist the item if necessary.”I sent her this reply:
“Thank you for removing the picture.
I do wish you would have replied to my messages sooner. Since they were not replied to, I had to send a “Notice of Claimed Infringement” to eBay which can reflect badly on you. I did give you a chance to reply by postponing the day to send that fax.
For future dealings in uploading images: when an image has copyright on it you shouldn’t use it, unless you get permission from the owner of that picture.
Thank you”January 2, 2010 at 8:14 pm #797826I’m glad this got resolved for you but how unfortunate that seller didn’t get hold of you un til they had to! A simple request of permission to you to use that photo would have saved a mountain of heartache! That seller ignored you until they couldn’t anymore and did what they did because they had to! Ask permission next time–I have and usually the answer is yes! How simple is that??????
