June 25, 2008 at 3:46 am #717643John should be told about it. This is an infringement, though the original artist probably didn’t know they were doing wrong. 🙂

My art: featherdust.comJune 25, 2008 at 3:55 am #717644Wow! 😯 That’s a very nice sketch based off the male dragon.
June 25, 2008 at 3:59 am #717645you’re not allowed to draw the dragons?
June 25, 2008 at 4:24 am #717646It’s very nicely done, even if it is an infringement.

Its copying. 🙂
Its very well done but too bad they didnt draw their own stuff.

oops…
is it not copying if I put like Windstone somewhere on it?
I drew a picture of the scratcher for my art class. We were supposed to bring an item to class that meant something to us and draw it, so I brought him in and drew him. He’s hanging on my wall.

June 25, 2008 at 5:06 am #717650Hmm…I drew the mother dragon and emperor ages ago when I was in highschool-I even have the emperor drawing on my dA account and when I realized it, added a copyright to Windstone, should it be removed all together? I did it 10 years ago and never considered it being wrong 🙁
June 25, 2008 at 5:12 pm #717651If I drew it it wouldn’t look like a Windstone anyway

As long as you don’t try to sell it, or display it publically as your own invention, why would anyone care? If it is on your wall, just for your enjoyment, you’re not removing any profit from Windstone, and if it is never seen outside your own wall, I’m not sure how it infringes on their trade dress or however it is spelled. 😀
June 25, 2008 at 6:58 pm #717653You might add inspired by or original image by Windstone Editions (Scult Name) to the bottom of the piece and that would be attribution. As long as you aren’t selling it or using the image to profit from I don’t think you are breaking any laws. There should not be a problem of something you did yourself for yourself in the privacy of your own home. K

Sun Dragon Koi #3June 25, 2008 at 7:41 pm #717654i think this is a question for Melody and john. I know this all has been discussed before and I think it has to do that when you post the drawing, then you are publishing it by legal standards, and that where things get tricky for protecting Melody’s style.
BUT my mind is really fuzzy on the subject and I can’t remember all the nit picky-ness over drawing a windstone item you legitimately own and then posting it on the net.
June 25, 2008 at 11:54 pm #717655This is still infringement. When art of any form is copied in any form without the original artists permission it’s infringement.
Leigha, if I was you I would approach John with this before someone else does.
Here is his email:
john@windstoneeditions.com
The worst he will probable do is ask you to take it out of your photobucket album and just keep it to yourself. 😉 -
