April 20, 2008 at 7:08 am #691863Yikes… Well, the dirt and damage dont look too bad. Some, like the bent tip, he may not have even noticed since its been in his possesion so long. After a while, you dont even know its there. I would suppose that, bottom line, if you are not happy, then return it. Its better to be out $160 than $675. You may even be able to file a dispute thru paypal and get all your money back… minus the $25 fee they charge. The item is certainly not as described.
April 20, 2008 at 12:45 pm #691864Well I emailed the seller and asked for a partial refund since it is not new as he said and it was damaged. Here is the message I send him in reply to his, hopefully it’s sounds ok and doesn’t offend him:
Hi Bill,
No I don’t want to return it!
It would cost me another $80.00 to send it back and then I would be $160.00 down the hole.
I’ll keep it, but to be honest with you, I wish you would have told me that it was not new since it was displayed in your home and covered in dust.
According to eBay’s definition of “new”, it should have met the following guidelines.
“It is in the original condition from the manufacturer, distributor, or retailer.
It has not been refurbished or used for any purpose.
It has no known defects or damages.”
I am dissapointed in this.
It did arrive damage with scratches and really dirty and I can barely make out Julie Bell’s signature since it has rubed off over time.
Maybe you had not notice the scratches but the rest is pretty evident. And you might have gotten the dragons with the crest on the head already bent.

At this point I would at least expect and I am asking for a partial refund for those since it was not new and is damage.

“Hi Natalie,
If this were to have been new it would cost you almost $2000.00. Not the 650 you paid for it. The dust can be cleaned off with a damp cloth. I AM ALREADY SELLING IT TO YOU FOR FAR LESS THAN I PAID FOR IT. I also marked it as a gift on your customs form to save you some of the fees you would have to pay to receive it. I have offered to refund your money to you. I believe I have done enough to save you money from this purchase.
Bill”I did not ask him to put gift on the custom form and we all know that customs ingore the mention of gift these days because they know better.
He sent me another message and now he is denying that it was new as he stated.
“Natalie,
I have taken the time to view your pictures. I have also looked up another statue which is for sale on ebay for $200.00 more than You paid for mine. The comb on the dragons head in that one is also bent. Just as mine was. I am willing as a token to refund you $10.00 which will cover the cost of your cleaning supplies to wipe the dust off the statue and to clean the sphere. I am doing this as a token of good faith as I should have cleaned it before I sent it to you. Nowhere in my ad did I say It was brand new or Just out of the box. Waiting your reply. Also you are comparing my statue to a catalog . If you are going to compare than also compare the price of that catalogue piece which was almost 1200.00
Bill”I sent him the following message:
“Bill,
I asked you in an email through eBay if it was new and you said yes it was and in excellent condition.
‘new and coa ex condition check out my fee back no box’
Because you said that, I thought I was paying for something new, yes I agree I got it for a good deal but I still thought it was new since you confirmed it. When someone says it’s new and in excellent condition that is what you expect to get.I will forward you the message you sent in the next email.
Thank you”
He doesn’t seem to understand that I want to keep it but would like a partial refund for the damage.
$10.00 refund? 😡 Give me a break!

I am willing to give you a refund less your shipping or $10.00 for cleaning. It was dusty and i am willing to give you the $10.00 for that. But the picture in my ad shows it on display. If you would like a pic of the one on sale showing the bent comb I will send you that. I feel that is more than fair. After viewing your pics the only thing I can see is that it is dusty and once its cleaned I don’t think you will see the so called scratches. Other than that I will refund your purchase price less shipping once i receive the statue.

Oviously he doesn’t get it and also won’t admit to lying to me about it being new!!

I’m easy going; I would just clean it and ignore the guy. I’d leave feedback saying item was not exactly as described, though.

Makes me never wnat to buy from ebay again!

I got mine the first day they hit the catalog which is how I get #1. The Michael Whealan Dual of the Dragon came out first at $1500 but did not sell and htey lowered the price to $750. When Julie Bell came out with hers they also started and ALL sold for $750. Well that is until they put them on clearance which is when I wought the one I sold to Wolflodge100. This man is CRAZY if he is trying to tell you that is wht they sold for
