Problems with a purchase need advice.
I purchased the following and received it a month later damaged.

Here is the message I sent him when I did the payment:“Note:
Hi, I just paid you through PayPal.
Could you please not put more then the subtotal for the value of the item, that is the amount the customs use to determine how much tax I pay. Do not include the shipping as value for the item. It would be appreciated.
Please package carefuly with lots of padding, I worked at a post office and know firsthand how careless they can be. They have a bad habit of throwing and slaping things down. Do NOT use UPS or FedX for shipping service, I’m not home to accept packages and their offices are extremely far.
Please make sure that the items being sent are the same ones as in the auctions. I received once from another seller an item that was not the one I had purchased, so now I include this note with all payments.
Thank you.”Now some of the jars are open and there is powder everywhere. It is sealed and I have not opened it but from the looks of it the jars got really shaken some are not placed the way they should have been in the package and there is a tear in the seal and that would explain how the powder got all over the external package and my hands.
I contacted the seller and sent him 2 pictures of the package I received:
and this was his reply:
“Hi Natalie:
Thank You for the photos. It seems to be readily apparent that the post office went to great lengths to play with your package. As noted in the photo, the package was placed in a cardboard protector and foam paper. While maintaining that balancing act between absolute protection and reasonable shipping charges, we believe that the photo shows that your package was more than adequately protected. We were able to see the powder on your hand but the glare from the flash makes it difficult to actually see the containers, although you mentioned that some appeared to have loose tops. It seems to be apparent that the plastic wrap on the package was not opened before we shipped.
Normally this would be a matter of invoking the notation on all our listings that we cannot accept responsibility for items lost or damaged by the Post Office unless insurance has been purchased. However, you have been very courteous and patient through this and we are prepared to offer you a $10.00 refund to your PayPal account to make up for the loose powder, which you obviously can’t use for your projects.
Please get back to us.”
This is what I should have received:

The seller did not package it with lots of protection like I had asked with the payment. And he said because of the glare from the flash he can’t see much…well I did not use the flash…you can’t see much because of the powder that is covering the inside of the package. One jar is totaly empty.
He is willing to refund me $10.00 on my US $36.49 purchase (not including the shipping) of Jacquard Powdered Pigments PEARL EX 32 Color Set. I had asked him to package it carefully and to make sure it had lots of padding. He only wraped cardboard arround it and sent it in an plastic envelope. It was slaped down, trowned….well you know about our mailing system….
Now I don’t know what to do…do I ask him if I can open the seal to see the extent of the damage and then decide if I accept his $10 dollard refund or do I just explain to him that because it was not properly package in the first place that it’s how things got broken and ask for a replacement or a refund.
What scares me is that it already makes a month since the purchase and we all know that to make a dispute you only have so much time.What would you suggest?

January 15, 2008 at 9:29 pm #656409I’ve moved with my pearl ex, and other dry pigments. I can tell you that I packed them well and had the lids on tight and they still leaked a bit of powder inside the container I packed them in. These mica particles are very fine and dust everything. π
If you are unhappy, by all means follow up and see if they will do a replacement.
If it was me, I’d accept the $10 refund and have a party! You got a steal on those. I paid a lot more than that and I don’t have nearly as many colors. A tiny bit goes a long way- even if some of them spilled a bit, you will take years to go through that even if you used them daily. π
You are not me though so do what you feel is the most fair for yourself.

If you have a real mess on your hands then see if they’ll work with you for a return/replacement. If it’s just a layer of dust then you should be okay.

January 15, 2008 at 9:53 pm #656412Well, you’re down one jar out of how many? But you have roughly 30% of your money back? You still have way more than 30% of the total powder left, so I’d say you’ve been treated quite fairly. Let it rest, and enjoy your pigments.
January 15, 2008 at 10:26 pm #656413I tend to agree. If you can salvage the loose powder and put it back in the jar you’ll be okay. I buy my pigments in 1 teaspoon baggies and even with using them daily I’ve yet to run out of any of my colors yet. π The pearl-ex jars have at least 10 times that amount. π

January 15, 2008 at 11:52 pm #656415Ohh I am sorry to see that it did not arrive to you in one piece…when I purchase loose powders from ebay..I usually have them shipped in plastic zip lock bags and the containers empty…to avoid what happened to your package.
As for advice..it’s really upto you I guess…you only have two options…
1. To try and save as much of the powder as possible and accept the $10 from the seller
2. To put a claim through ebay…and say that the package did not arrive as described, and say that you will ship it back to the seller for a full refund but rememeber to get a tracking number for ebay and you will get your refund.I hope this helps…. π

January 16, 2008 at 2:19 am #656416I’d take the $10 and not worry about it. It sounds like you got a good deal on those, even with the one spilling everywhere. You can even replace the one color with that $10 he is refunding you. It’s too bad it didn’t travel well, but it could have been a lot worse.
