I wasn’t sure if I should post this in here or in the General forums but I was curious to know if anyone (maybe from Windstone, or just someone who is smarter than me XD) knows if there are any production colors that aren’t taboo to come close to in color scheme?
For instance, I know for sure that old brown is a licensed production color and it’s a straight copyright infringement to paint, for instance, a PYO dragon as a brown with purply and light blue spots and gold tips. However, I am curious about the other colors that have been put into production that (to me) may be a little more of a wide range and possibly not protected by the copyright – off the top of my head I’m thinking red fire/ruby type coloring or white – colors that would be really easy to accidentally copy!
This isn’t in ANY WAY me wondering what production colors I can get away with painting with the intent to sell as official Windstones – I had a discussion with someone about it and was curious if anyone knew 🙂 Some of you may know I have scared myself before, thinking I had this great color scheme and then realizing it’s in the same realm as a production piece – only to find out that of course it was different enough not to matter!
So yeah.. I’m not sure if I’m phrasing this well but hopefully someone will know what I mean!

Much of the protected look that Windstone has are the placements of the colors used, not necessarily the colors by themselves. The particular uses of counter-shading, some of the gradients, etc… and especially combining with the gold accents (according to John) is the biggest problem.
For example, I have seem many PYO painters use the same colors that are used on the official Peacock Windstones. However, they are applied in a different way and in different parts of the statues, and not blended in the same manner, and so they look different and are far less likely to be a problem.
I hope this makes sense? John could say it much better than I.
As for the look, it is not covered under copyright exactly, but under trade dress, which protects the overall look and design of the color, shading, statue, accents, and all… and no one piece is ‘less’ protected than another. No one owns the color “red” or even “red and gold” but the manner that the red and gold colors are applied to a Windstone dragon along with metallic gold paint accents is protected (Red Fire). Does that help?
