i hope he can to , but an OSHA violation is grounds for dismissal. we used to have OSHA people all the time come into the Caterpillar plant i worked at and fire people on the spot with out the authority of the supervisor ..its legal but i agree one site should be over looked especially if it wasnt handed down by an OSHA thug. i do understand their ethic though ,since it only takes one violation to kill some one in the shop .
I hope he can get another job soon , with 6 years and certification he should find something . best of luck
That totally sucks. HD fired my roommate for a BS charge like that as well. They had a policy change “that morning” did not tell her about it them fired her for breaking the “New Policy.” It was just an excuse to get rid of her because she had been for a while and was making good money. My sympathies Drag0n, Hope it all works out for you. 🙂

And unless he was making a scene, he was publicly humiliated by being escorted from the building, and that could be grounds for a lawsuit. I think. Depends what the laws are out there, but I don’t think you are able to escort someone from the building and force them off the premises for your ‘fun’ and ‘entertainment’.
Just fight the urge to hit him, and see if you can’t find some free legal counseling in your area. Some places do offer the counseling, and will tell you whether it’s worth your time, without charging you.
I feel the same way you do about punching him! That is so cruel! I am really glad he could apply for unemployment though! Just be careful about being VERY specific to the unemployment office about the income now because my hubby just generalized when he filed for unemployment a couple of years ago, and now he owes money to them. The only time that really sucks is if he were to get fired again, then they wont give you any unemployment money. I don’t want the same to happen to you two. *hugs*
Thanks everyone so much! I’m feeling better then I was, but we’re still both really upset and equally pissed off. We both applied to Lowe’s and he also applied to a few other places online. Like local supermarkets like shaws, stop n shop, stuff like that. Tomorrow morning he’s going to take a bus down to the center plaza in town and apply around there to circuit city and target. His manager John called and said he is good friends with the store manager at circuit city and will try to put in a goo word. Nobody is really hiring now though. After X-mas, people will be getting rid of holiday help.
It’s just a horrible time of year for this to happen and I’m just really frustrated mostly with the lack of compassion from my boss, Ryan. He’s such a coward I’m sure he will avoid me at work tomorrow anyway, but I still don’t want to go. God forbid he does try and bust my hump with his smug attitude I WILL be right behind Shaun at the unemployment office. I can take a lot to my face and shut my mouth, but not a complete and utter disregard for respect like that. It’s just cruel and it makes me feel like he just wants to see me squirm! It’s nauseating. I’m honestly counting the minutes until I can tell that @hole off!
Thank you everyone though. Really, if I couldn’t vent here I’d be loosing my mind. I still don’t have a working cell phone to even call my family.

If your state is a at will state you might not be able to fight the termination, however you still may qualify for unemployment. If you have children, can’t remember if you did or not, you could also apply for welfare. I would also sign up for the low income power bill break and any other programs like that that you could qualify for.

I can only ditto what everybody else said. I’m really sorry, and I wish you and Shaun the best of luck in finding him a better job.
Bj’s did this to my husband a few year ago (fired for a BS reason) he actually succesfully fought, got his job back, but then they turned around a month later and came up with another BS reason to fire him, and he was tired of fighting. I totally understand how upset and frustrated you are, and I can only say fight it for the sake of fighting, but it’s probably best not to go back to working at the HD anyhow. As long as the manager is there, he’ll just keep picking until you leave. Good luck on finding new jobs.

I don’t think I’d have been able to restrain myself, job or no job, so kudos to you for that.
My best wishes to Shaun in his upcoming job hunt, I hope he finds a place where he’s properly appreciated and compensated–and where his boss is a decent human being.

I hate big corperations just for that reason! They will just keep writing you up over and over again for stupid things so they can find SOME way to either make you quit or end up fired. It’s just a loop hole when you sign your “at will employment” rights away. It’s just a real slimy way to get rid pf people when this time of year comes and they need to “trim payroll”
Just as I thought Ryan is completely avoiding me too. I feel ashamed just wearing this ridiculos orange apron. I packed up all my personal belingings and took off all my customer award pins and patches. I’m just preparing for the inevidable.

I know I went through it 6 months ago. Ed and I had worked at the same job for 4 years, without ever seeing a raise. Our manager hired another person to do the same job as Ed, this guy had no expierence but because he was friends with the owner they started him out making $2 more than what Ed did. I found out cuz the guy was a jerk and liked to brag. Well when managment wouldn’t even consider increasing Ed’s pay I lost it. I told our manager exactly where she could go and I walked off the job imediately. Ed quit 3 days later since nobody there would even talk to him. This left the new guy to learn how to do his job all by himself since Ed was the only other person who knew how. 👿 I hope our ex-employers were happy. Oh and the new guy, he was fired 3 weeks later for misconduct and he had distroyed the company vehicle he was driving. XD Karma’s great!
I just got out of the office. I got called in there because John had told Ryan I was holding “anamosity” towards him in the situation and he couldn’t understand why. I got in there and Ryan was asking me why I wasn’t mad at Shaun for violating saftey procedures and why I was instead angry with him for simply doing him job in ensuring the saftey of fellow employees.
I know saftey is a huge issue and policies for it are strictly enforced, but take his license away for the forklift or do SOMETHING besides a straight up termination, on Christmas, after 6 years of service. I hate when managers are COMEPLETE @HOLES, but they say the most awful things in the NICEST possible way to make you feel like your the one who is wrong. I swear they must train them at a bullshitting academy. He should have won an award!
I stomached the whole conversation about how if Shaun simply followed procedures we wouldn’t be in this situation so I have nobody to blame but him for this situation. Now I need to focus my attention on making sure I don’t follow the same path. He just wiped his hands clean of the whle situation…it was very cut and dry. I feel like I’m going to puke!
He kept saying things like “do you think I wanted to do this? do you think it made me happy to fire him?” I wanted to shout out ARE YOU KIDDING!!!??? Then he was proceeding to say how unprofessional it was for me to want to leave and take him to apply for jobs and perhaps I should even rethink my relationship with someone who can’t do it themselves without me to do it for them! The gawl!?!? Then he started in on how much of a valued employee I am and how sad it would be if I followd the same path. It would be such a shame to loose a designer just in the prime of her carreer, and don’t I agree? I felt like I was on an afternoon drama show.
I can’t take this crap. I’d rather be on the street then have this jerk to answer to. 👿 It is taking every SINGLE OUNCE of strength not to walk right now! I want to just WALK SO FREAKING BAD RIGHT NOW!
