They did NOT take out the OOAK wording.
“this auction is for a rare and one of a kind black unicorn statue/figurine. “
That was in there till the end. While I don’t agree with bashing the seller for leaving a negative if the buyer didn’t pay in the requested time frame, it was shady to list this unicorn as OOAK, even after he/she was told otherwise. Then that is crap. 😕 Thats probably why it went so high, but I hope not.
December 4, 2007 at 7:01 pm #640762Im only saying what I did because this seller has done this to more of his buyers than not. Ebay barely gets out an automated invoice in under 24 hours AND if the seller doesnt do one manually, then the buyer is left without knowing how to get into pay. Just a thought.
And yes, the OOAK was left in there the whole time. Im also not just basing my comments on this one transaction. Im taking into account his whole history, what he has said about all his other negs, and what they have said in retaliation of their own. Dont ask me why I went so far into research… well,
…perhaps I did because it was a Windstone and I knew ppl here would be watching and bidding. Plus, I always tip my head when someones FB is that low. There is a reason for feedback in the low 80s. Thats more than just one or 3 times of coincidental poorness.
And dont forget- Im a seller on ebay too, so dont bash me! 😉 I was just saying all this because of my interest in YOU guys! Especially at that price with this particular buyer. And I admit, maybe Im slightly tainted because of my recent bad experiences on ebay with Windstones but Im trying to be impartial as ppl I bought from had better FB than this seller. Afterall, FB is there for a reason.
But- to each his own.
December 4, 2007 at 7:16 pm #640763Thank you for looking out for us PT. I agree that a feedback score in the low 80s is something which puts me off a bit as well. 🙂
December 4, 2007 at 7:23 pm #640764Yea, Im not saying that if you dont have 100% FB that automatically means youre a poor seller! Hardly! I just start to get nervous when FB dips into say, 93% or lower. Then I take it seller by seller, do my research and see if their score is actual or retaliatory; and then I bid.
But everyone has their opinions.
December 4, 2007 at 7:36 pm #640765Im not bashig at all… very nice of you to point it out, though I do hope everyone who ebays looks at seller feedback and reads the entire auction. If not, they are asking for it. 😉
December 4, 2007 at 8:22 pm #640766By all means I agree! We do look out for each other when it comes to bum sellers after all. 🙂

My art: featherdust.comDecember 4, 2007 at 8:52 pm #640767Most of my buyers do not follow my rules (which is contact within 3 days, payment within 5). I dont neg them. I gently remind them of what the terms were and ask whats up and we go from there. And like most who sell, I do need the money. Ive made no bones about that. But everyone has her own way of selling and dealing with buyers.
For instance, my auctions say I only accept PayPal and Money Orders/Cashiers checks. No personal checks. But a new ebayer sent me a personal check in the mail. I contacted her and told her to be wary of auctions rules in the future and check payment forms. Told her I dont accept personal checks but being that it’s here I’ll accept it. It just needed to clear which I explained to her.
Im willing to work with any buyer as long as they communicate with me- even if they didnt follow my easy rules.
December 4, 2007 at 10:05 pm #640768Since the auction said OOAK to the very end could the buyer claim misrepresentation and get out of this? Just asking.

My guess is this seller would spin that back onto the buyer and say “you should have asked question prior to bidding.” In a way, he’d be right but if youre not familiar with Windstones, wouldnt it be hard to decipher what is OOAK or not.
Like someone else said, since the person already got slammed with a negative without any communication from seller, Id not even pay at this point. What more can they do? Open a dispute, sure- but Id try my luck in there in this case because I believe, given the buyer and sellers histories, that the buyer would have the upper hand. Or so I hope- and yes I am pulling for the buyer though I dont know who it is.
December 5, 2007 at 12:02 am #640770The seller can file an Unpaid Item Dispute and the bidder may have a strike put against their account. If they get enough of them in a short period of time, eBay can suspend their account (for a period of time or indefinitely.) I don’t know how eBay would rule on this dispute because of the false OOAK in the description. It is “buyer beware”, but the seller has the responsibility to list their items honestly.
December 5, 2007 at 6:50 am #640771And no matter what you say in your auction for when payment is due, you cant open a dispute until a predetermined amount of time that eBay rules say. I remember I tried to open one after 6 days of non payment and no communication and ebay said it’s too early to open a non-paid dispute.
Ive followed it all the way I can go and have lost interest in the topic at hand. I feel badly for the buyer and thats my siding, so to speak. Even if Id needed that piece, the simple defensive and nasty nature of how the auction was written up would have put me off. FB would have been the topper.
We’ll never know what theyll do after this, so again, my interest has waned. But I just hope karma is alive and well out there and not just doing commercials! 😆
December 5, 2007 at 6:51 am #640772Ah shoot, it does say one of a kind. Sorry for the misinformation, Ski. 😳
December 5, 2007 at 8:01 am #640773Thats ok. I hope the buyer doesnt pay, since its not OOAK. I hope thats why they didnt pay.

I think you have to give at least 7 days.
December 5, 2007 at 3:09 pm #640775That’s what I was thinking too. 🙂
