I think it-s rather foolish to want to paint something new as a commission anyway. She obviously has never tried the PYOs / what makes her think people will commission a beginner? Her other art is fine, but she wants to be paid to to practice. 😕 Rather bold.
January 16, 2007 at 10:27 pm #528487What I’d be afraid of, is if you were to use those photos yourself later on, would people think that you’re the one who’s using someone else’s work.
And what if you want to sell that beautiful kirin? Would buyers think you’re copying her work? I find it to be very touchy.
And also, what if her paint jobs are not up to your standards? Will buyers associate your name with hers in the future?
I understand about offering support to another artist, but it’s not worth your own reputation!

Shall we all start emailing her? Let’s revolt and send in the troops. What she did was just flakey.
January 16, 2007 at 11:15 pm #528489It sounds like she’s already been contacted a couple of times about this. I’d say wait and see if she responds to Watgergazer’s questions before we pester her.
I mean… it may be that she’s broke enough that she can’t afford $30. Starving artists, you know. I’ve been that poor before myself.
January 17, 2007 at 12:05 am #528490I’m sort of with Water in that she’s not necessarily a bad person for this, just…mis-informed. When I was first starting out, I didn’t know the etiquette and protocol either.
I do, however, see this as an incredibly bad decision/move on the auctioner’s part, and hope she responds well to water’s email. I especially think she needs to take Water’s paint jobs off her website!! O.o!!
I think Water is probably better than most of us at gently correcting. If she needs nasty, though, I reckon she’s got plenty of recruits here. 🙂
January 17, 2007 at 12:46 am #528491I would agree that Water is being VERY nice about this. I am a “new” artisan and I still know not to use other’s pictures to represent my work. After looking at her website, I’m wondering how much painting she actually does. I just don’t think her first PYO’s are gonna compare to Water’s.
You know, this brings up an interesting question. Could anyone just copy a photo out of the gallery and use it in this fashion? Sure, it’s not right, but whats to stop someone? Maybe we should think about watermarking our photos?
January 17, 2007 at 12:52 am #528492The thing about copying work/photos is that sooner or later, you get caught. Maybe not right away, but eventually, and when that happens, your rep takes a pretty mighty ding, if you’re the copyer.
People start to question which works were really yours, or if any of them were yours at all, even if some of them are.
Getting caught copying brings a whole host of problems most folks really don’t want in the form of karmic backlash, more or less. And copyrights and watermarks can be removed, if your crafty with Photoshop.
Take your photos, ask that they don’t be redistributed, and leave it at that, and if they pop up somewhere else, you can put your foot down. 🙂
January 17, 2007 at 12:56 am #528493I would highly suggest putting a watermark on anything you’re really attached to, that you would be upset if you saw somebody else claiming it as theirs.
It’s the internet. The vast majority of people on the net don’t understand copyright, and many of them don’t care. Most folks think nothing of copying images, using them on their websites, putting them up in galleries, using them as myspace backgrounds, making them into icons, drawing copies of them, whatever, without giving credit to the original artist. Even with a watermark, some folks will remove it and use the image anyhow.
That’s the reason why I boycott sites like ebaumsworld, because they steal people’s work and don’t give credit for it.
But that said, I’ve always thought that it’s futile to get too worked up about it. Stop art theft when you can, educate people when possible, but if you go around being paranoid about people using your art, you’re just going to give yourself ulcers and accomplish nothing.
Just my two cents’ worth.
January 17, 2007 at 1:02 am #528494Oh, Water…I know you don’t want to be rude, but this just keeps getting worse and worse…It’s really not mean to tell her she can’t use your photos as examples, and it’s really unsafe for you to allow her to do so. She either doesn’t know any better or she’s trying to use you, and if she doesn’t know any better it’s best she learns ASAP that this is NOT appropriate!
I think as the owner of one of the other wolves I will email her about this as well. This is very upsetting!

-J R R TolkienJanuary 17, 2007 at 1:12 am #528495Just as a note of caution: if you start watermarking your PYO photos make sure you don’t put something to the effect of © your name… this can be misleading to people not in the know and can possibly cause problems for Windstone. If you put something on them something such as:
Copyright © Windstone Editions / Melody Pena
Painted by Your Namewould be appropriate. This text is easy to add even in MS paint which comes standard on all Windows OS machines and would not only protect you, but Windstone as well, and potentially gather not only possible commissions for you but new Windstone collectors too! 🙂

January 17, 2007 at 7:59 am #528497Okay, just my 2 cents. I think Water was VERY NICE in letting her use the photos as examples for her auction, but her website? This is a clear example of giving someone an inch and them taking a mile. I’d be upset about the website. The ebay thing, not so much if she has permission. I would be very careful Water. She should have links to your site along with the photos and a clearer statement that YOU painted them ALL! I would at least want to see what she delivers first before you affiliate yourself with her. She isn’t very professional to do this in the first place. I agree that supporting starving artists is a good thing, but I would never be so arrogant as to post other peoples work on my personal website. That’s common sense. I was thinnking of bidding on the griffin auction, but I no longer care to. For some reason this whole thing is leaving a bad taste in my mouth.
You, Arlla, Skigod, and myself, everyone else had to practice and make their own paint samples. It’s not fair for her to boost her own auctions by “using” you like this. I know it’s your decision, but I just don’t want something bad to happen to you because of it. The webpage thing is bothering me alot. That’s just ignorant. She doesn’t even put your whole name down on the page which is completely inappropriate.

The more I think about this, the more angry I get! HOW CAN YOU USE SOMEONE ELSES ARE TO SELL YOURS??????????? 😡 😡 😡 😡 GAH!~! Its CRAP~! SHE did not paint these and the auction is not even clear WHO DID!!! Its misleading and CRAP CRAP CRAP~! I feel for the folks who bid and I really hope that this “artist” has some talent.

I agree, just the sneaky way she twists some words here and there bother me. It reminds me of the way my mechanic talks to me to make me buy things I don’t need.
Its too bad, I was a bit interested at first but this whole thing just soured me. She states several times she doesn’t care and just wants paint samples, but clearly is trying to inflate the price by putting up pictures of Water’s work. Clearly because Water has been getting good money for her PYOs and gullible buyers will be mislead. It was very clever of her, but sneaky. I don’t like it one bit. The way it was at first with OTHER samples of her work was much better and MUCH MORE honest. She should expect the first ones to go low with no paint samples of her own.
She could have easily done what most of us do and paint a few samples to sell AS IS and then do comission work with her paint samples she previously sold. It doens’t take a genius. That’s how I got Water’s first tiger griffin. She can earn her way as we all did.
