I bought this thinking it was a good deal, but it wasn’t because it arrived in a small box. The gargoyle was wrapped in a plastic bag. When I made the payment I told them how I wanted it wrapped and I also told them I wanted insurance on it. Well they claim that they didn’t read the paypal and are giving me all sorts of problems and they didn’t put insurance on it(this is what she said):
I will give you half of your money back when ever I recieve the Gargoyle back. If it was damaged, it had nothing to do with me and I am sorry for that. The item was in PERFECT condition when I sent it and was packaged just fine. You can also click on the item number to view it’s page and very clearly see that I did not offer any type of insurance. I have never had a problem before with any of my items ever being unsatisfactory to my customers so forgive me if i’m not very inclined to believe your claims. The pictures I took of the Gargoyle were taken the day I listed the item & packed it. Also, that very same day you bought it. I took pictures of the front, back, side, and bottom of the Gargoyle to show that there was not any damage. I am sorry something could have happened to the statue, but it was in perfect shape when it left my hands. What ever could have happened while in route to your home is not my fault. I did my best to give it cushioning in the box and that is all I could do. These things do happen and it is no one’s fault. Perhaps if something you buy is ever over a certain price you should make sure there is insurance to protect yourself because accidents do happen. Again, I am sorry but there really is not too much more I can do.
I had told her that I wanted my money back and it was because of her poor packing skills that it was broken. I told her that I will provide her pictures if she would like, but I will not settle for half of my money back and her getting the item back.
If she doesn’t change her mind I am afraid that I am going to get a negative feedback just because she seems like that. I had paid on the 7th and it 9 days to get to me well minus Sunday. If she doesn’t change then I won’t have any choice but to leave her negative feedback and put her on THE LIST. Sorry, just venting…feel free to leave suggestions.

My suggestion is that you file a claim with e bay…stating that the item is damaged…in my past experiance ebay has been really good, they will review the whole situation and hopefully force the seller to give you your money back, just amke sure to explain it to them in full detail.
Hope this helps. 🙂Marzena
August 17, 2007 at 1:02 am #608733Yeah, I think I will have to get them involved cause the seller is being a stickler.
August 17, 2007 at 1:08 am #608734Hmmm….I particularly like the part where she advises you to get insurance AFTER stating that SHE doesn’t provide it. If you have to pay S$H back I don’t see that it is worth it just to get 1/2 your money back. I had a broken dragon arrive once without insurance and the seller refunded 100% of the money. I would give her a negative and if she gives you one back I think you can explain the negative.
People like her is why it is called EvilBay 😈
I’m sorry you are having such a miserable transaction.
August 17, 2007 at 1:09 am #608735Wrapping a breakable/fragile sculpture in a plastic bag, then setting it in a box does not constitute sufficient cushioning. I find it funny that on her auction it states “If there are any special requests for anything, I am more than happy to help.” Apparently adding insurance to an item if requested or packing a breakable item properly don’t count 🙄 Sounds like she doesn’t really go by what her auction says, on that account anyway. I’d email her pictures of how the little guy arrived because of her incompetence.
I’d contact ebay and get them involved if she is being such a stinker.
August 17, 2007 at 1:16 am #608736Umm, yeah. That is what I thought she wants to give me half of my money back and wants me to return the statue…Yeah, right. I could of probably gotten a mint one for $20 because they aren’t that popular.
I do agree with you Siberakh, she does state that in her auction and that is a good point. I think I will bring that up to her.

August 17, 2007 at 1:28 am #608738Thanks DM. I am afraid that I am going to need it.
August 17, 2007 at 1:34 am #608739It sounds like it. I bought a Franklin Mint big dragon to replace one I broke a tiny scale off of when they where fixing my roof and ceiling and the guy wrapped it in newspaper and foam paper and it broke in 3 pieces. I e-mailed him and told him how it arrived and he insisted on refunding the entire amount to me. I offered 1/2 but he said if would not feel right unless re refunded the entire amount, so there are a few good ones still out there. I did not have to send it back to him either I just tossed it. He did comment that it was had to wrap for shipping
August 17, 2007 at 1:54 am #608740Oh yeah she needs some negative feedback for that. It’s her fault weather she likes it or not. Good luck with getting your money back. I wouldn’t worry about the negative she will leave you since you can explain why under it.
August 17, 2007 at 1:58 am #608741Well then you got lucky. I had 1 Windstone broken in the mail before. It was a small peacock wizard and the dragon had broken off during shipping. It was packed poorly. The seller refunded all of my money including shipping first and then he said to send back the item. At that time, I was looking for Mint peices and if I would of known that it could of been fixed I would asked for a little refund back and kept it.

The thing is that I worked for 3 years to keep it that way. I know you can explain it but a lot of people don’t look for what happened and why you got it. 🙁
August 17, 2007 at 2:04 am #608743well still I wish you the best of luck here
August 17, 2007 at 1:18 pm #608744What a hassle! I hope things get resolved for you quickly. Getting Ebay involved would be a good idea. Is your gargoyle fixable? If so, I’d be happy to help patch the little guy up.
