I paid him with the cash I had in paypal, I wish I would of paid by credit card now, I thought Paypal was there to protect you against things like this but I guess they do not care if someone sends you a broken item. 🙁
They DO care. You need to report it as item not as described. Dont even mention shipping. Just tell them that the auction stated it was mint and the dragon was damaged. I hope that helps. At a minimum, the seller should refund you minus shipping. Something…
November 20, 2008 at 4:48 am #736033I filed a not as described complaint and they said the claims process only applies to the shipment of goods and not the quality of the goods? I tried to file another claim and paypal will not let me file again on this.
Here is what Paypal said
Our investigation into your claim is complete. As stated in our User
Agreement, the claims process only applies to the shipment of goods. It
does not apply to complaints about the attributes or quality of goods
received. Therefore, we are unable to reverse this transaction or issue a
refund.I also emailed Paypal about this and they never replied back.
November 20, 2008 at 6:46 am #736034So something is only “not as described” if you actually don’t receive it? Huh?
November 20, 2008 at 6:46 pm #736035That sounds like a bunch of doggie doo. I would so be calling Paypal and complaining until they let me talk to a manger. There has to be some way that this seller should be held to an ethical standard.

November 20, 2008 at 9:01 pm #736037This was through a Windstone dealer that I paid through paypal through there website. Paypal will not do anything about the quality of the product they sent me. The Dealer told me to get a lawyer or file insurance fruad on him 😯 Kyrin is fixing him for me and I emailed John about this dealer as He did not want to think that his employee could accidently over look the damage, He says she is a ROTC student and is the most honest employee he has ever had but she did not look him over that well as she missed the damage to the claw and she packed him very poorly which I took pics of everything and emailed him and he just said I must of dropped him as they do not ship damaged items 😯 I do not want anyone else to go through this with this dealer. As any dealer that tells you to get a lawyer or commit insurance fruad does not need to be selling windstones or anything else. Thanks
November 20, 2008 at 9:56 pm #736038Since the dragon was shipped through the mail and was significantly not as described, could you file with the post office or police as mail fraud against them? Seems to me that I heard that somewhere.

Sorry. How about just a flat out return? Do they not have a return policy? Maybe you can go that route. If they missed the damage going out, they will probably miss it coming back in. Just a thought.
November 20, 2008 at 10:29 pm #736040This dealer said that he will not accept returns and that my only choice was either to call a lawyer or file insurance claim on him. I brought him to the post office and they said that the packing job was horrible and that they would not file a claim so the post office will not even accept it as all she did was put him in a box and only put a handfull of paper on top of his box, There was nothing to secure his box from being tossed around in the other box so they will not file a claim with poor packing. I tried everything before posting about this. I sent the email to John about this dealer and what happened. So far I have not heard back from him.
I am happy that Kyrin offered to fix him for me and I am looking forward to getting him back in one piece.

Not impossible, if there are huge gaping holes in the box, my peacock emperor’s box had a huge hole in the side and most of the smaller bits were long gone by the time he arrived on my doorstep. However, if the item is enclosed in a plastic bag and you try to say it broke in shipping and there are no pieces, then you are caught in a lie.

KyrinIf there were holes in the box then im sure the poster would have known where the peices went, right? If it was in a box, inside another box, and in the bag, it is pretty impossible for the peices to get out. Unless they just disintegrated… which is pretty unlikely, too.
November 21, 2008 at 8:17 pm #736044He was packed in his bag in his windstone box, There were no holes in the bag or box and the other box he was shipped in did not have any holes either, If he was damaged in shipping there should of been pieces or dust in the bag and windstone box he was sent in but there was nothing. I took pics of the everything and sent it to the windstone dealer and he said to either call a lawyer or file a insurance claim but with there bad packing and missing pieces the post office would not do anything about it and the dealer will not respond to me anymore since I did not file a insurance claim and of course paypal was no help with this. I am just happy that Kyrin offered to fix him for me. I wonder if John got my email I sent him as I have not heard from him about this dealer.
