I take it there was no hole in the box or anything? Although nothing I’ve ever ordered has arrived broken, I can honestly say that every box I have ever received has come with large holes in it (thank you Windstone for your amazing packing) so perhaps some pieces may have fallen out through a hole?
Even though it would seen unlikely that ALL the pieces fell out of a hole.
Strange that Paypal wouldn’t side with you, that’s a pretty bad offense, item not as described.

As bad as it is, being an irate customer usually gets you what you want (this coming from a sales associate >.<)

I am assuming the “bag” is the plastic bag that Windstone Editions sculptures are packed in to protect them from abrasion against the cardboard packaging. If so, then the statue HAD to have been damaged before being packed or there would have been bits in the bag.

The girl who shipped him to me told her manager she checked in over and there was no damage but there are no broken pieces or anything else in the windstone bag and both boxes and all he tells me is that she is a honest and is a rotc student and she would not lie and for me to file a insurance claim or contact a lawyer about this.
When I filed the claim with paypal and got no response from him I escualted to claim and Paypal emailed me and said
Our investigation into your claim is complete. As stated in our User
Agreement, the claims process only applies to the shipment of goods. It
does not apply to complaints about the attributes or quality of goods
received. Therefore, we are unable to reverse this transaction or issue a

If you did use a credit card, the next step is to go to them.

Not all dealers are like this…I get WIndstones from Emerald all the time, and have nothing but good things to say about her shipping or packaging. USPS can bust the hell out of a Windstone, sometimes even when it is packed supremely. I have also bought from Astral Castle and alot of mine came from ebay.
I am really sorry you have had this cruddy luck on this deal. refund.What kind of bull loop hole is that!?!? I’m really disappointed in Paypal for not actually TRYING to solve a customers problem! I’d want to take someone to court just on principle for getting away with that crap! That’s just not cool, not at all! I’m sorry you have to deal with such a jerk!

Who had that list btw??? Anyway, it won’t do to list him publically here, but whomever has the list if you would speak up so the info can be sent to you, that would help. I don’t think a dealer who is not willing to accept the word of a customer and do his level best to make things right doesn’t deserve to be patronized further.
His responses really rubbed me the wrong way, basically saying his employee honesty is more valid than Dunreining’s, basically put, he called her a liar, and that doesn’t sit too well with me, she’s been very honest in all dealings I have ever had with her and frankly I trust her more than this nameless “perfect” employee.

It seems as if a seller can pack an item how ever he or she wants, and as soon as its out of his or her hands, its not their responsibility anymore, and the buyer just has to suck it up and take it. 👿 And that’s just not right! I would tell the guy to pay for repairs anyway. Or give you a partial refund. The dragon probably isnt worth what you paid for it anymore, now that its broken, so he owes you something back.
How bad is the damage? Is it just a claw, not a whole toe or foot? If thats the case, the girl could have overlooked that. Im sure the average person doesnt look over Windstones with a fine tooth comb and a microscope like we do. 🙁
November 6, 2008 at 5:03 pm #736028I have called and emailed the dealer telling him I sent him to be fixed and that the girl overlooked the damage to the back claw when she shipped him to me and even sent him pics of the damage and the packing so he could see the poor packing and that there was no dust or pieces anywhere of the claw but he just told me to get a lawyer or file a insurance claim as his Employee that shipped him to me is the most honest employee he has and he trust her when she said she looked him over and he was fine. I have emailed them several more times and they will not respond back to me anymore as they perfer me to either take them to court or file insurance fraud 😯 Kyrin offerd to fix him for me and I shipped him to her to be fixed 😀
I do not think they need to be a Windstone dealer if this is the way they act when some thing gets damaged. They also told me this windstone was only there 3rd windstone to get damaged and that I must of dropped him 😯 as they do not shipped damaged items 😯 I wonder if Melody or Susie would do something about this dealer since they are people that should not be selling windstones and if something happens its either your fault,or they want you to commit insurance fruad or get a lawyer and bring them to court as they do not ship damaged items? an I wonder what happened to the other 2 people who recieved damaged windstones from them and if they told them to commit insurance fraud or to get a lawyer or that they must of damaged it and its not there fault?? Hi! This is actually usually something that John deals with I think. If you feel you’ve been treated unfairly by the dealer, you can always contact John and express your feelings. I do not know Windstone’s policies when dealing with this sort of thing, but you should never be afraid to voice your opinion on a dealer to John. I am not sure what he can do but I think he should know what this dealer pulled, I have emailed the dealer several more times about this and he will not respond to me which makes me mad as I have done everything I can think of to show him that the damage was over looked and it seems he does not care as he does not ship damaged items, Well I emailed the long email to John so at least he knows about this dealer now and I am hoping he does not do this to anyone else. The good news is I have sent the dragon to Kyrin to be fixed and I am looking forward to his return 🙂
