I bought a Jade Oriental Sun Dragon from a Windstone Dealer, Well They shipped him in his windstone box and then his box was put in a larger box with only a handfull of paper packing, Well The dragon arrived and his back claw is Broken and here is the Strange Part, The broken pieces are Missing, There are NO broken pieces in the bag or box he was shipped in and I looked through all of it. The Windstone dealer claims the girl who packed him very poorly checked him over and there was no damage on him and to file a claim with the insurance company or call a lawyer?? Well If he was damaged in shipping where are the broken pieces of his claw?? I told him that the girl most likey overlooked the damage and packed him and sent him to me this way but after telling him the pieces were no where to be found he then said I must of dropped him then and wants me to file a insurance claim on a dragon who has no broken pieces anywhere in the box/bag? What I need to know is Has Anyone ever recieved a windstone packed in there windstone formed box and packed into another box that arrived broken but the broken pieces were missing and no where to be found? I have searched all through his bag and all through his windstone box and the other box and there is nothing in there. I have never had a broken windstone arrive with the pieces missing before.. He does not want to take blame for shipping me the damage dragon and is trying to say the dragon was broke in shipping but there is not 1 tiny spec of his broken claw anywhere to be found in his bag or box. I figured I would ask and see if anyone else has had this happen to them? This is Very Upsetting and I can not believe a Windstone Dealer would Act and treat someone like this. 😯
Update on this Windstone Dealer.
I keep emailing this Windstone Dealer telling him there are no broken pieces anywhere to be found and that person accidently overlooked the damage to him when she shipped him to me, I told him if he was broken in Shipping there should of been broken pieces somewhere or at least some type of dust or something in the bag/box but there is nothing in there and that the post office may not file a claim without any broken pieces so show he was damaged in shipping and Here is what he emailed me.While i hear what you are saying, my employee is certain this left in a perfect condition, and your own insistence is going to make a claim impossible, so i am even sorrier than you are. we do not ship damaged art.

I do not think this guy should not be a Windstone Dealer if this is how he acts when something like this happens. When you buy from his store like I did it goes right to paypal to pay for the item so I paid by paypal, I have Filed a Claim with paypal saying the dragon was broken and that there were no pieces or anything in the bag/box he was shipped in and that I am sure it was a accident the girl over looked the probelm, He has not responded to the paypal claim yet, He did respond to me emails saying that the girl who packed it is a Honest ROTC Student and she claims she looked him over but I am sure she did not as there should of been some type of broken pieces some where in the bag/bag but there is nothing so I am sure she overlooked it and does not want to get in trouble so she is lying about his condition before she shipped it and considering her poor packing job I am sure she did not look him over. I am hoping between me emailing him and the paypal claim that something good will come of this.
Ok Paypal WIll NOT Do Anything about this since the item was damaged in shipping?? They cancelled my claim Saying

I’ve gotten my share of broken Windstones and at the very least if there aren’t pieces there are some signs of ground up white gypsum in the box and wrapping. You should find SOME fragment at the very least!
I think the dealer is most def trying to pull a fast one over on you!

October 12, 2008 at 2:51 am #736006That is very strange. I would expect something like that from some ebay sellers, but for the most part that’s rare to. Sorry your dragon arrived in such a mess 🙁 .
October 12, 2008 at 4:22 am #736007I don’t buy it, if he was intact when shipped, then the pieces should be in there if he got broken in shipping. Tell him he owes you a discount, I would ask for enough to cover repairs and shipping for them.
If he doesn’t make it good, then file a claim against him on PayPal, I hope you paid that way, if not then if you paid with a CC then you can file through them. They are most likely to side with you and you would get some compensation that way.
I can give you a formal estimate for you to use to pursue damages if you choose to go that route. I’m sorry your dragon got broken, and the seller is a shyster. There is no way insurance will cover if there is no evidence of broken bits in the packaging proving it was damaged in shipping.

Same thing broken claw on a white scratcher – not even the puff of gypsum powder was to be found in the box 😯 . When I looked closely at the picture posted here I could see that the damage had occured BEFORE being shipped to me but the seller gave assurances that the dragon was undamaged . Despite sending the pictures requested of the damage the seller has refused to work with me on this one & as I am not the only person on the forum that she did this to I’m not holding out much hope of resolution .

I was thinking the same thing.
I bought the white hatching Empress from the same “FRIEND” and she got here missing her left horn and I got the same speech and even after the threat of taking this person to court for fraud I still have not heard anything from this person.
Mine was so poorly packed it was CRAZY. I got the hatching Empress and a White Mouse wizard each in a ziplock bag put in the box with almost NO cushion whatsoever and that was the only damage, but stilil this person was told several times we are very HARD NOSED collectors and if it’s advertised MINT it better beOctober 12, 2008 at 7:10 pm #736010Did you pay the dealer with a credit card? Filing a claim isn’t as a horrific process as it sounds (although, still not fun) as long as you can clearly demonstrate to the CC company that the seller is in the wrong and didn’t provide the goods in the condition promised, which, from your description, sounds like you can.
Always possible the employee/packer did break the piece and did not and will not tell the owner. So the owner might really think you are lying, and not just trying to have you commit postal insurance fraud. 😕
If it was me, I’d photograph everything, including the outerbox, keep all the packaging and file a claim with your CC or Paypal (if you paid that way) if you are really, really, really certain that the piece didn’t break off in shipping (If the piece isn’t hiding in the bag or box somewhere, doesn’t hurt to check your floor incase it fell out!).

As far as you are concerned, you bought something and it did not arrive in the condition it was advertised to be in. It doesn’t matter how it got to be like that. Normally a seller would work with you, but because this guy won’t, send it back and demand a refund.
Make sure to use a carrier that can provide you with proof of delivery (UPS, FedEx, return receipt mail). If your proof is via the Internet, print out a couple of copies.
If the fellow refuses to refund your money, or even fails to immediately say he will refund it, and you paid by credit card, call your card issuer and dispute the charge (it’s harder to do this if you are still in possession of whatever you paid for).
The sender should not be suggesting you deal with an insurance claim; that’s his job if he wants to try getting a reimbursement on the grounds of damage in transit.
Unfortunately, he knows he won’t get anything that way so he’s trying to make you believe it’s not his problem.
The fact that he’s suggesting that one of your options is to see a lawyer means you may need to take him to small claims court if you didn’t pay by credit card.
Of course, everything is different if you want to try to negotiate a partial refund and keep the statue. I don’t have much advice on that. I’d imagine the fellow would just laugh at you, given his attitude so far.

October 13, 2008 at 7:18 pm #736014I paid him with the cash I had in paypal, I wish I would of paid by credit card now, I thought Paypal was there to protect you against things like this but I guess they do not care if someone sends you a broken item. 🙁

I can honestly say every time that I have recieved a windstone that was broke in shipping there were at least some of the pieces (or dust) in the box with the piece. Some times some of the pieces will fall out of the box though. When my black male unicorn arrived broken he was missing some of his pieces.
