The Ebayer wants to file a claim, considering how poorly the dragon was packed, what do you think the odds are in getting any money out of them?
It is starting to look like I might have to eat this one if I want to keep the dragon.

I just hope he is not doing this in order to buy himself time.

Because it was not packaged propurly in the first place I seriously dought they will cover you.
The seller is at fault here not the shipping company.I had a seller do this to me. I had not received my items (fossils) and I had paid insurance on them.
The seller finaly responded to my messages once I file a dispute.
He said he was going to go to the post office and file a claim.
We stayed in contact and he was telling me all the time that he had not heard any news.
The dispute was going to close so I contacted him and he said he would go find out the next day.
Well me being naive and trusting 🙄 I beleived him.
I found the post office in his area that he was dealing with and the clerk said he never filed a claim.
By then it was too late no items and no refund.

KyrinYou can always take the dragon up to the PO and see if they would even honor a claim. If not, you can get a statement from them and send it to the seller and see if he will be more willing to partially refund if the PO says his packing was at fault. No telling though. Seems folks are often unwilling to accept fault even if its staring them in the face.

This was delivered through FedEx…and I really think the chances of them honoring the insurance claim is slim to none. But I told the guy I would humor him on the condition that he request that they pay for repair versus scrapping it.

April 8, 2008 at 5:28 pm #684855Well it finally came down to filing a claim. But I won, and got half my money back. Which is all I wanted, since I am keeping the dragon, I didn’t think it would be fair to demand a full refund.
He’s not happy, but then, neither am I…after all I had wanted an intact dragon, not one I have to rebuild, but I’m not complaining, I can work with what I have here.
At least it’s over and done with. I am just not going to give him any feedback at all, since from the tone of his reply to the claim, he would likely give me negative just to be a jerk. And at this point giving him a neutral is just not possible.
His excuses for failure to communicate is that he doesn’t get online everyday…when you are selling something online, you really need to check in at least once a day, and if once you’ve sold it and something goes wrong, you really ought to be checking in daily. If you can’t manage to do that, then you shouldn’t be selling stuff online!

Really, I didn’t catch that. That would be a good thing, because what is a buyer’s responsibility, to pay, right? So why should they get negatives unless they don’t pay? Once you have paid you should get good feedback.
When I sell, I always send feedback once I’ve been paid. I don’t hold it over the person’s head so that they will give me good feedback through blackmailing them. Not cool.

It’s not blackmail. That’s pretty harsh. I always withhold feedback to buyers until I get it from them first. I do it to make sure they have contacted me if there is a problem to see if I will fix it before they give me negative feedback. You would be surprised at the things I’ve gotten threatened with negative feedback for: clothes not fitting (sizes are in every auction), color not being the same as in the photo on their monitor (photo is of actual item unless it states otherwise, so I don’t know how it could have changed), not getting it within one day of shipping (cause, you know, the post office has instantaneous shipping). If I wait until they give me positive feedback, then I know that everything is okay. If they don’t give me feedback, I know I should contact them to make sure they got the item and that it’s okay. And if it’s not okay, I try to fix it. It’s certainly not blackmail… more like a precaution.
With Ebay changing their rules, I’m sure I’m going to get negative feedback for the stupidist things. That is one of the reasons why I’m closing my eBay store (not Emerald’s Emporium, mind you). I’m not dealing with their unfair rules any more.
