She has to keep from using the same colour schemes that she’s seen on them, so that she’s not infringing on “Copyright” for lack of a better way to put it. And so that people don’t get confused in what is or isn’t an official Windstone colour. If I’m not correct I know I’ll be corrected!! 😀

As for repainting them…I have no intention of selling this one, I bought him for me. If I were planning to sell him, or was repainting him for that purpose, I can understand Windstone having an issue with it. However, in this case, since he will never leave this house, I think repainting him will be okay.
The Orientals, well…not sure what I can say in my defense, except that they were broken, and while restoring them to original is possible, it is more fun to do Koi, they just seem to call out for it.
I will say, that the Sun Oriental I did was not originally meant for sale, but I fell on hard times. The other one was sent to me for repair with a request to repaint him since he was already so compromised with the break and the other repaint done previously.
I also want to say that I will not be making a habit out of repainting things.

To be fair, the one oriental you are doing was already repainted, so he’s just… evolving? 😆

Disclaimer: Only John, Melody, and the Windstone lawyer can give exact legal.. uh.. quotes? In other words, they are the final legal voice on this stuff. Anything they say overrides what I say!! What I say should never be taken as legal advice, etc.
But, how I understand it: that though no one can own the colors they apply to a repaint legally (if someone repaints a Windstone they do not own any sort of copyright on it), we are trying to be really nice and not intentionally create anything that is too close to an existing item that has unique colors This is Melody trying to be nice and trying to create less confusion (which is one of the biggest problems repaints pose). The exception would be that natural colorations do not belong to any one person– If, for example, one of us at Windstone wants to do a Koi-anything, that really isn’t stepping on anyone’s toes because koi patterns have existed on real live koi in nature for hundreds (well, thousands, really) of years, no no one owns it.
When I am working on my artist’s editions on production cast pieces (anything that is not a PYO) I try to be very mindful of the existing colors that Windstone has produced on the sculpture I’m working on. For example, I don’t want to do a black dragon with purple and gold highlights- it’d look like a Black Gold dragon.
This has been pretty easy thus far as I can easily check through Windstone’s galleries and say “Oh, good, I’m not too close to that color” or “Ooops, I’m getting close to that color, let’s change it a bit.”
Repaints are such a wildcard though because I have no way to keep track of what people have done (and, it’s a little unfair to have a color ‘taboo’ to Melody, Oly, myself, and any future official Windsotne artist just because someone repainted something similar, especially after we discouraged it).
I lost a lot of work because I inadvertently painted something that was very very close to a repaint that I didn’t know about until I was very nearly done with my dragon. To be polite I’ve since reworked him, but that was a lot of time to lose when this is my living. :/
We knew it would happen and it’s not a big deal, but this is one of the many reasons we discourage ’em.

Oh ouch that had to hurt having to change the dragon when you were nearly done. If it’s really that big of a problem, is Windstone able to just say “Don’t repaint, period”?
“Discouraging” repaints leaves room for folks to do it anyway and when they come up on hard times, the repaints are usually the first to go.
I understand the compulsion, but if it’s becoming this kind of problem, maybe they should just nix the wiggle room of the word ‘discourage’.
March 31, 2008 at 3:33 am #684826I don’t think they could enforce that, though, except maybe on ebay. o.O Even then, as long as the seller states that they’ve repainted their piece, I don’t see how it could be fought. = If someone buys something, it’s theirs to jack up however they want – even if it’s a Picasso.
And I’m not just saying this because I asked Kyrin to repaint my ex-purple Oriental! XD I wouldn’t have asked if he’d only been broken, and not repainted already, too. I wouldn’t have even bought him, in that case – I don’t need two Jade Orientals, and he could have been easily repaired to like new, if not for the repaint. >.>; If I ever had to sell my Windstones (wild horses would have to drag them away), though, I don’t think I’d sell that one (or it would be the very last to go!), because it was the most once-in-a-lifetime-find of them all! 😉

I concur! Especially if it affects the work that you do… The repaints are magnificant sometimes, but it’s not worth your job.
March 31, 2008 at 3:54 am #684828I haven’t actually seen that many repaints, come to think of it. Maybe I just haven’t been on the forum long enough, but I can only think of a few –
Kyrin’s Sun Dragon, PurpleCat’s Emperor, that pink bunch (forgot who owns them), the young dragon mmloda currently has for sale on ebay, and I swear I saw a koi oriental once (I think Kyrin said Whippetluv did it). Then, of course, there’s the mysterious ‘Red’ set mentioned on Astral Castle’s encyclopedia…but where else have you guys seen them? Repaints, that is. Not the elusive Reds. XD Which I’m also curious about – have any of you actually SEEN those? Or are they just rumor?March 31, 2008 at 3:58 am #684829I have a repainted scratcher that was done a few years ago by Watergazer. I believe it was painted before Windstone took an official ‘stand’ on repaints. The person who commissioned it resold it on ebay a month or so ago.

Yeah, they are tough to ship, but if he had done as I requested, most likely the Emp would have arrived intact.

March 31, 2008 at 3:24 pm #684834I feel your pain for your broken emp Kyrin! I’m in the process of fixing a broken one myself, and he has very similar damage when it comes to the legs and tail. My advice is that you’ll have to work fast when retexturing the large areas. Even though ApoxieSculpt doesn’t set up right away, there’s a small window between when it’s plastic enough to work with and when it starts to crack and gain a crumbly appearance. I hope you don’t have to repaint him either! Melody was nice enough to send me a sample of the peacock paint so I can patch mine up, I’m sure if you ask she’d do the same for you. Best of luck!
