      Related to the depressing topic, but now it has turned to unrequited ANGER!!! 👿

      So I’ve made it semi clear I don’t really want to post about my personal life that much anymore, BUT I need advice on anyone who has ever had to file a claim on their home owner’s insurance while having a mortgage and “is this normal?” Me being a “newbie” home owner I don’t know if this is normal or not but it SOUNDS ILLEGAL!

      SO! If you read above, my sister and I got the check and tried to cash is but the bank said “no” The mortgage company, which is Aurora Loan Services, is also on the check to the insurance company said they also need to sign it in order for us to cash it and then start the repairs on the house. Now this has been going on for 4 and a half months now between US and the INSURANCE COMPANY.

      SO now, Aurora has to get involved since we need them to cosign the check.

      I call them Friday to find out where I’m supposed to mail out this check we can’t cash, and they tell me their “policy” on how this works. They send us a “package” of forms to fill out and a special envelope to send the check in. There is also a “release” form that must be signed stating that we are siging all other parties to the check are null and void as far as our rights to this money and by signing we are giving all contractual obligation and decision making solely to Aurora Load Services and Affiliates. We mail them the check and forms signed, they KEEP the money and only AFTER we get estimates from contractors, mail them out to Aurora, have THEIR adjuster ALSO come out and VISUALLY acess the job AND approve the contractors estimates, they pay 1/3 of the amount for the materials and labor, THEN only pending approval, (she said “pending approval” and awful lot) they release the second 3rd of the money when the job is half way completed, then, once again, pending ANOTHER final approval and VISUAL inspection from a mortgage company HALF way across the country will the release the final 3rd of the money!?! WTF? Keeping in mind it can take anywhere between 3 to 6 weeks for each payment to be processed, approved, and mailed to the homeowner. WHAT CONTRACTOR IS GOING TO TOUCH THAT JOB?!

      “Um, yes sir, can you do this job for a third down, and pending the approval of a mortgage company (not even an insurance compay) they will decide if you can get paid the remainder of the job pending 3 seperate on site inspections. Oh, by the way, we no longer have the rights to this money incase the decide not to pay up and also you’ll been to wait up to 6 weeks after you have completed the job to even see if you can get paid in the first place” :negative:

      When I told them how utterly ABSURD that was they just said, NO WORD OF A LIE, “well we just need to make sure you fix OUR house and don’t pocket the money and run, since it is TECHNICALY our property for the next 30 years” :shout: If I could have slapped someone via phone call that would have been the moment! I shouted “There is A HOLE IN MY *insert explitive here* HOUSE! OF COURSE I’M GOING TO FIX IT! I didn’t put a new 10 thousand dollar roof on this house last year because I was planning on taking off with a fraction of the money I’ve already put into this house and hitting the town! To now have a big hole in the side of it after investing so much into it is pretty IRRITATING, and they fact I’ve had to deal with the insurance company for the past 4 months while the side of my house rots away, I’m ALREADY going to have to put extra money into this job now”

      So then she told me to calm down and that was the policy, blah blah blah. Okay! When I had a car loan, and my car got totaled, I GOT the check! Not the car loan company! That’s what I pay for insurance for! What kept riding my nerves, was the lady kept emphasizing it was “THEIR” house every single time she got to use the words “Well, it’s OUR house Ma’am” so I snapped “When I see YOUR name is on the DEED it’s your house okay lady!” After clarifing that I understand correctly and arguing about it for about 20 minutes about their ridiculous policy, she then had to mention “Oh, and by the way ma’am, you do realize your 9 days late on your current payment. When do you plan on addressing that? As quickly as the hole in OUR house?” I LOST IT! I screamed that if it was THEIR house then THEY can pay the mortgage, and THEY can pay the insurance, and THEY can pay the taxes! I’d sooner LIGHT this check on FIRE and mail the ashes to them and rip every single shingle off this house I paid to get put on it! Ya know what, the hole is on the side of the house and I don’t have to even look at it so when THEY feel like it they can have the insurace company issue THEM a check so THEY can come out here to fix THEIR house whenever THEY please!” and slammed the phone down! *&@$%*&@$&*^@*$^@*^$*&!#@ I HAVE NEVER BEEN SO FURIOUS IN ALL MY LIFE!!!

      SO now this check is REALLY useless becase of my temper, but I have never heard of such a thing! WTH do I pay for insurance for if I can’t use the money?! Is this NORMAL??? Is this how home owners insurance and mortgage companies work?!?!?!?!

        My mother suggests that you go see a lawyer. You might have a claim against your insurance company because they did not secure the property against further damage. Now you have more damage than was originally caused by the car. Someone should have made sure no water got in.

        You have an action against the owner of the car, because he is responsible for the initial damage and the subsequent damage as well. Go see a lawyer…advice from a lawyer.

        Just having a lawyer talk to the insurance company will get you a better result than talking to them yourself.

        My father suggested refinancing your home with a different company as soon as this mess is dealt with. What they are doing is not technically illegal; they do own the house since you have the mortgage with their company, but this is beyond the pale. She also did not need to bring up that you are nine days late; don’t you have a grace period? You should still be within it. At that point she probably got tired of dealing with you, and decided to throw salt on your wounds.

        If you do refinance, don’t tell your mortgage company until you have found a company with better business practices that suits you and Shaun. You’re right: when damage occurs beyond your control, it is the insurance company’s job to pay. That’s what you have it for. You are getting a runaround because your mortgage company doesn’t want to pay. You don’t need to put up with this aggravation; there are better companies out there to hold the loan on YOUR house.

          I would LOVE to refinance! I’ve been trying for over a year, but we needed to build some equity since we hadn’t owned the house for very long (hence we got the new roof and did other rennovations as well) See, our mortgage has already been bought out 4 times so this wasn’t the mortgage company we signed up with. Our’s WAS local, then we kept getting new letters in the mail that our loan had been bought out by this bank, then the next, and so on. Now it’s Aurora who happens to have the loan now. *grumble* This is NOT what I signed up for! Bah!

          Also, since we are current with our mortgage (yes, I’m in the 15 day grace period) we aren’t able to get priority on refinancing because so many other people are struggling to pay. THEY get priority first because they can loose their house if things don’t get done. I understand that, but don’t punish people who ARE paying their mortgage. My tax guy told me that I SHOULD stop paying my mortgage for 3 months, and only then will anyone entertain either refinancing us or giving us a loan modification. It sounds risky, but I’m so pissed at this Aurora I just might do that now! Also, my sister has TONS of credit card debt. I did the consolidation program, but out debt to income ratio is still awful because she relys mostly on tips (which she doesn’t claim all of) we have that against us as well.

          We tried to midigate the damages on the house as best we could by patching up the vinyl siding as best we could until we could get the money to do it right. We didn’t expect it to take 4 months to get our check after our insurance adjuster sent in the estimate and it got approved all in about 2 weeks after it happened. Everything was supposed to be all set, then just trying to GET the elusive check was a whole different story with calling the insurance company twice a week and always hearing “Oh yep, you should be getting that ANY day now” day after week after month! 👿
