If I was in a car crash, and perhaps had an injured spine, but would likely be fine if transported safely to a hospital, I’d be pretty darned pissed if some passer-by dragged me out of the vehicle thereby ensuring, albeit inadvertently, that the damage was permanent.
Don’t they teach us in classes in school: “Only move a crash victim if there is imminent danger”? Like if the car is actually on fire, or there is a train coming and they’re on the tracks?
Why would anyone think, for someone who says “I can’t move”, that the best thing to do is drag them out of the vehicle, instead of waiting for an ambulance and people who might know what they are doing? There’s almost no chance that a car will just “blow up” after running into a pole. There was no reason the injured woman needed to be removed from the vehicle.
And also, I doubt that it was the injured woman who initiated the idea of suing her “rescuer” – more likely it’s her insurance company.

it’s my understanding that the rescuer was concerned about fire, not that the car was going to blow up.
And regardless of whether or not the damage was there before, or after, perhaps I would be pissed and looking for someone to blame, but suing?

First of all, no amount of money in the world is going to bring the use of my legs back, and second of all, this person had every intention of doing what they thought was the right thing. I couldn’t bring myself to bleed them of every last cent the had. It won’t make me feel better, it wouldn’t fix a darn thing and it will make the next person somewhere else hesitate in that crucial moment when someone else’s life could be saved.
Pat yourself on the back, you’ve put another nail in humanity’s coffin.
This kind of sentiment makes me furious, whether it’s the woman who came to the decision on her own, or her insurance company who pushed her into it (after all, she could have said ‘no way’).
I’m First Aid and CPR certified (I have to be, where I work, because I have to respond if something happens) but you’d better believe I’d think twice before helping Joe Schmoe in the street after this. I don’t have any money, to have some ungrateful @$$hole ruin me because a rib broke during CPR (which happens, you’re doing it wrong if it doesn’t), but hey, he’s healthy enough now to happily bleed me of anything I’ve got left.
No way.

Good Samaritan laws shouldn’t have fine print.

I wouldn’t have said it as strongly, Rusti, but I do agree with you.
I mean, the lady saw smoke. I would have thought “smoke+gasoline=fire=explosion!”
Geez…if I see someone hurt, should I make a verbal contract with them before moving them?

You would think that the woman would be grateful. 😡December 24, 2008 at 6:46 am #747193This is one of those cases where I think the accuser needs to be slapped upside the head, her lawyers and whoever instigated her to sue be given some real work to do so they don’t go making problems where there are none, and the judges who bother with this case should be fined and fired for ineptitude. (Even more so on the cases of suing McDonald’s because you burn yourself on coffee or suing a victim you’re trying to burglurize.)
I’m very aware of the dangers of good intentions, and I think that more damage has been caused by good intentions than bad ones, on any scale. But I don’t think that’s a factor in this case at all and I second what Rusti said.And p.s., for those of you who sneer at America for even permitting such cases, I can tell you there’ve been similar ones in Europe. America just gets a lot of attention because their cases are fought over millions instead of thousands of dollars.

When was the other lady supposed to act? After the fire had engulfed the car? And get sued because she didn’t act fast enough?
It bothers me to think that the one person who has sense enough to at least *act* when someone else might be in danger while everybody else stands back and watches gets this kind of reward. No wonder we have such a strong bystander effect in this country.

Right! Most people would just stand back and watch, and it is a rare person to act.

Ditto….I was also thinking of they guy who bought an RV, got it on the road, put it on auto pilot and then left the driver’s seat to make some coffee. Naturally he crashed and then sued the company who sold him the RV saying that the sales person TOLD him that he could “make coffee while driving” and I think it was in the brochure too (tangible evidence in court). Of course what the sales person and the brochure meant was “someone ELSE can make coffee while YOU are driving….” Common sense right? Ya no…the dip **** who crashed his RV won the case and the RV company had to recall and reprint all their brochures with better wording, along with retraining their sales people…

Well…ok, this situation is a bit more complicated than the above mentioned two, but it really does make one stop and ponder as a whole people’s good will.
Dave DOES make a good point, but I would have to agree that the woman pulled out of the car has gone WAY too far. Maybe her insurance company wouldn’t cover medical costs for the paralization BECAUSE she was drug out of the car?? In that case sue the insurance company for the medical bills and standard of living issues, NOT your friend and co-worker. (who might be tempted to finish the job and knock you down a flight of stairs when you came back to work after suing her? *probably not, just speculating the morbid*)
Anyway, as to any situation there is more than one side, and many angles to think about when looking at a situation like this. We shall see how it turns out. That is why we DO have the court system, so the facts can all be brought to light. The tragedy comes when the facts are misrepresented.
