February 5, 2008 at 1:55 am #659627Wow, that’s painful to look at. T_T; Personally, I don’t trust UPS to handle things gently, especially when they’re marked fragile. The UPS man that delivers to my store told me that a ‘fragile’ sticker is basically like putting a bulls-eye on the box, if that’s not the most messed up thing I’ve ever heard! Of the three major players in the delivery field (USPS, UPS, and FedEx), I’d usually say that FedEx is the most careful with stuff – and, of course, the most expensive. =(
Anyhoo, I’m sure none of that was comforting…but I hope you get your money back, and get him fixed. It looks like someone is very interested in trying. XDFebruary 20, 2008 at 4:03 am #659628Okay so maybe someone can offer some advice.
I opened a dispute with paypal (which I have just discovered has timed out and been closed) but the seller never responded to the paypal dispute. I never escalated it to a claim, and the seller is saying the money was already taken out of his account, without warning from Paypal.
I have yet to see anything that says ANYTHING about a refund….I have not seen a penny from this. I did send the seller an e-check to begin with, but I haven’t seen anything on paypal that even says that anything is pending.
The claim is closed (I haven’t been on the computer much lately and unfortunatly, it timed out on Feb 17 😕 and apparantly cannot be re-opened.
am I just SOL? Or does anyone have any advice? The seller is very unhappy about ‘the money being taken out of his account’ he ‘needed it to pay bills’ (don’t we all?) I don’t want to come of as cold hearted, but I don’t think it’s totally fair I should have to pay $167.50 for pieces and crumbs and dust of white gypsum stone.
Of course I’d most like to get a full refund and send the dragon back to him if he wants, but I’ve thought too, of asking the seller to pay to have Kyrin fix the spectral. I figure with her cost+round trip shipping, it should be about $60. I’d only be out $107 and I’d have a mostly okay dragon-who at that point, would be worth about $107. ? Thoughts?
February 20, 2008 at 4:28 am #659629It seems a little wacky that the seller claims he “lost the profit” from the sale but the money didn’t get back to you. 😕 You can try asking PayPal if a return of funds was attempted; I don’t know enough about PayPal to have a more useful suggestion. Regarding Kyrin’s repairs: I’ve heard nothing but good about her work, and a repaired Spectral is certainly better than none at all. If she’s game, I’d say go for it. I’m just sorry that you had such a bad eBay experience in the first place. 🙁 Good luck!
February 20, 2008 at 5:21 am #659630I don’t use PayPal for reasons just such as this. You need to get them on the phone and ask them what happened to the money. If they took it out of his account, it should have been put into your account. However, PayPal likes to ‘arbitrait’ with your money. They claim they’re investigating, but in reality they’re holding your money in funds where it earns interest for them. If you’d like to call to find out what’s going on and where your money is, their number is 888-221-1161. Please call and harass them as much as possible.
It was just things like this and talking with people there who would say “I’m not authorized to give you that information” that were driving me mad. Supposedly my account was somehow liked to another account in Oregon. When I asked what criteria they used to link them, then couldn’t give that out, even though it was my account that was being messed with. It was my business name, but they said it had to be more than that cause they don’t link accounts off only 1 field. Well, in the end they had no proof, held on to my money for 8 months until I could convince them to give it up, and I closed my account as they can’t be trusted. I’ve lost out on a lot of deals cause people prefer PayPal, but they don’t listen to the people and I feel they just steal your money and don’t really listen you. Sorry for the gripe, but that’s how I feel Hope this helps!

The ONLY reason I like them is because I get whatever I’ve bought faster 😆 But with Windstone, I try to send them money orders to avoid paypal. They deserve every penny of whatever they’re selling sells for! But with folks on ebay, it helps in situations like this. If I’d have sent him a money order, there’s no WAY I’d EVER see anything back.
What confuses me, is that the complaint was never escalated into a claim-they really shouldn’t have taken the money out of the seller’s account either-that’s not fair to him. But if he doesn’t have it, ONE of us should get it back. Ugh. Thanks for the phone # though! I will call them on Wednesday and harass them 😈

You may be entitled to the interest. I know that when a lawyer holds funds for an investigation they can’t keep the interest. It belongs to the money’s owner. Same for a CC company. Hmm…. Right now you only have to seller’s word that the money was removed from his account. Get proof. He should be able to tell through the history where the money went if it was taken.
February 21, 2008 at 12:44 am #659634I’m sorry it worked out so bad for you. I do know where an emerald spectral is for sale (or they had it a week ago at least), if you want, I can PM you the info. Kyrin does an amazing job with repairs, though- if she fixes it, you’d probably be quite happy with it. If you’re a mint collector, you could probably sell the repaired one for a fair bit.

February 21, 2008 at 3:18 pm #659637You may not see the refund in your recent Paypal activity. Go back to the transaction details for the original transaction when you sent the money to the seller. Look carefully on that page- at the top, it should say something to the effect of:
Transaction DetailseBay Payment Sent (ID #numbersnumbersnumbers)
This transaction has been reversed.
For further details please see transaction (Numbers)If you click on that, it should take you to the transaction reversal details.
If you don’t have all that, I’d definitely contact them. It took them nearly a month to give me a refund from a Paypal dispute I had to file.

So just looking at the box i knew something was wrong…I opened it and the dragon was killed and was left in small parts n dust. The only thing he has put in the box was the paper that you get from buying new shows. So i not realy sure what to do…Could someone give me some tips.

First off let me say I’m sorry to hear about your bad luck with the dragon. As for what to do that can vary depending on what you want (money refunded – you’d likely have to return the piece; money for repairs – Kyrin is the repair expert and could give you a quote to take to the seller. As for the shipping label was it one that was printed out on a home computer or a label from the post office that shows the postage price? If it is the second one, does that match with what you paid for postage?
No matter what, the first thing I would do is politely contact the seller and tell them of the condition you received the dragon the dragon (be prepared to give photographic proof). Then either ask for a refund or money for the repairs. If they react negatively start the claims process through ebay for item not as described. If that fails (and you paid through paypal) file a claim there.
If you buy pieces off ebay in the future, I’d suggest sending the seller the packing tutorial with a request that they follow it.

Ohh…some people…I can’t believe they would try and ship a Windstone dragon in a shoe box… :nea:
Well you can always file a claim with paypal and ebay stating that the item arrived to you and was not as described…it will take a while but if you proceed through to paypal you might get your money back…hopefully the person you got him from had insurance on him… :scratch: you should be able to get a refund….
And if you keep the dragon in the end…Kyrin is our Windstone doctor on here and she can fix anything, and if you PM her she can get you a quote of how much it will cost to fix him…I have had some bad luck with getting dragons shipped to me too and after they visited Kyrin they looked just as good as new… 😉Hope that helps… 🙂
