      I filed a claim twice as a buyer. The seller or the buyer can file a claim and choose where the check gets sent. I know it may get throwm in the trash, but really… the value, even repaired, is not worth what she paid for it. Should she have to suffer with a damaged peice just because we dont want to see it in the trash? She will never be able to get her money back for it in that condition if she does not claim the insurance. If she does keep it, she will either have to fix it herself, which she may not be great at doing, or pay someone + shipping both ways to have it repaired. The PO gets MORE money from her and does not have to pay for their carelessness. How is keeping it a better choice?

      Value of something really depends on whether you ever plan to sell it. You can say something is worth X, but if you never sell it, is it really worth X? (i’ve had this arguement with my husband for years over his cars, they are piles of rust that don’t run under their own power, but since they are rare he says they worth X, but he will never ever sell them, so really, they have no real value.)

      I definately feel she should get her insurance claim if she can, but I hope it doesn’t mean that the griffon ends up in the trash, he isn’t that badly damaged and is very salvagable.

      I also feel his value isn’t compromised that much with proper restoration, I know many of us here have previously damaged pieces that have been repaired, and I don’t think any of us feel they are worth less.

        I think they are worth less, but different people will feel differently. I just dont want her to get screwed because of the PO’s rough handling. If she wants to swallow the loss and then swallow the cost of repair, then that is her option. I hope she can get her money AND get it fixed. That would be ideal. If I had to choose between sucking up the loss or tossing the griffin because of a claim, I would take the claim. Thats just me 🙂

        I can see that, it’s the same with cars. My dad had this great little 1967 Datsun Roadster 1600 convertible, and some idiot in a huge water truck backed into it in the parking lot. Caved in the whole driver’s side and pushed it 25 feet before he realized he had hit something. The insurance company made my dad total it, even though it was just body damage. Because they felt the car wasn’t worth fixing due to it’s age, nevermind it is a classic.

        So he totalled it, but kept it, we salvaged it 2 years later. The body work still needs done, but it runs fine. We hope to fully restore it someday.

        I hope that mmloda can get her money back and keep the griffon to be repaired. Because it would be a shame to toss him out.

          I’ll know more on Tuesday the seller contacted me and he’s going to give USPS a call on Tuesday, so as soon as I hear something I’ll update this post….and Kyrin hopefully USPS will not ask for the griffin but I’m going to hold on to him untill I hear something from them just incase…

            😡 Now I’m a bit frustrated…the seller contacted USPS, I havent heard from them yet but he told me that he did, in the mean time I have put in a claim with paypal just in case and I just found out that the seller is accusing me of taking a hammer to the griffin and breaking it on purpose 😡 😡 😡 …I CANNOT believe this…

              What?! That is ridiculous!! Also, you should not start a claim through paypal unless the seller is being uncooperative. It can freeze their account in some cases. Just go through the PO. If the buyer keeps acting like this, then def go through paypal. It takes less time, though it costs $25, and you get to keep the griffin.

                Well Personally I think that he is trying to get away with giving me a refund…and that is why he put that in the dispute with paypal, I’m going to be really upset with paypal 😡 if they in fact take his side on this and I will end up putting in a camplain if that is the case, but I guess I’ll just wait and see what happens.

                  Try to go through the post office and get your refund. All you need is the receipt from the seller. Just have him mail it to you and make the claim.

                  You should use the same argument that Melody said in my thread that I posted “Caution about buying Windstones”.

                    A couple of years ago I received (sob) a white emperor dragon in pieces. I contacted the seller who told me to take it to the PO. I did and the first time an uninformed employee of PO told me I had to have the paperwork from the seller. I got it and took the dragon back to the PO. This time I got an employee that knew what she was doing and she told me I didn’t need the sellers paperwork all I had to do was bring the broken item and the packing material in. A few weeks later I received a check for the amount I paid for the dragon including s/h but I did have to give them the dragon.

                      some years back I sold my black gryffy
                      I double bubble wrapped him Taped that in place then packed him in a box with enough newspaper to keep him immobile … then PUT that box in a larger box with penuts … i spent a decent about of time doing this and yet he arrived with claws broken also. I sent the buyer to the elfwood? some sight melody had pics on talking about a possible future mother gryphon(this shoudl date it for you it was probably 3 years ago) i did also mail off the paperwork for a claim i guess she determined to fix him and got advise from melody here i think … I don’t know whom it was but i’m glad they restored the gryffy

                        Newspaper’s no good for packing windstones. It can compress and let the poor thing bounce around in its box.

                          well thats why you compress and crush it first it was what i had and penuts alone no good because they are too loose was my thinking and i didnt’ have enough bubble wrap then for the whole box tho maybe that would have been better
