I’m getting sued! YAY! *throws confetti* 🙄
The court official just dropped the paper work off at my door. Seriously, I don’t even know why I hired a credit consolodation company. I would have been better off just ignoring my debt instead of trying to take control of it. Now I have Discover AND Visa suing me for like 3 times what my inital bills were for…not to mention filing fees, court fees, and lawyer fees. I have my trial for Discover in October and now I have to deal with this one too.
GAH! I’ve never even been to court before… except like traffic court, but I have a feeling this is going to be a lot different. At my last meeting at the district court house they were asking how many witnesses were being called and so on and Discover has like 5 witnesses. 😮 WTF!?

July 10, 2010 at 2:24 pm #820865I hired a debt consolidation company which gathers a monthly payment from me based on my income. Then THEY distribute the money to my creditors and settle my debt for me. To do this all for me of course I had to pay about $2,400 in lawyer fees which were deducted out of my first 18 payments to them. So now, they have been paid in full for their service and they are supposed to be gathering money in an escrow account to be used to settle my debt. That’s the basic idea. In the mean time, I am not allowed to pay my credit cards on the side or it will void the contract I have with the debt consolidation company.
( I did all of this when Shaun first lost his job like a year and a half ago and I knew I couldn’t keep up with my payments with him out of work, so I did this as a way to avoid not paying my credit cards and getting myself into trouble and getting my credit score all messed up)
Things are different now, Shaun has been back to work for almost a year now and as of last month, he got a promotion to about that of what he was making before he lost his old job. At this point though, too much time has passed and I’m locked into a contract with the debt consolidation company until 2015
The consolidation company can’t stop my creditiors from wanting all their money as opposed to settling on a lump sum or a lower payment. So, my two big credit cards (the only ones left I have to pay off) are both taking me to court for what I owed them, plus a years worth of over limit and late fees.
They can draft paperwork for me, but the debt consolidation company isn’t going to send anyone to actually defend me in court. I would need to hire a lawyer or defend myself. I guess it looks good that I am doing this instead of filing for bankruptcy, but still. I’m just stressed out and nervous. I got Judge Cunningham too and he is a VERY MEAN JUDGE! He has a bad reputation for being very strict and I’m just really nervous! :puke:

July 10, 2010 at 3:21 pm #820867Get hold of the lawyer you had and that credit consolidation company! You had a contract with them and they were supposed to help take care of this. Yes, credit companies don’t like dealing with consolidation companies. If you were paying a monthly amount, there should be something that could be done. Get all your records together along with any payments you made. My neighbor’s son went through this and had some credit companies calling threatening to sue but he didn’t have real property. I think in your case since you own your home, they figure they could get something out of you.
So sorry this is happening to you! None of us needs anymore stress in our lives. I hope it all turns out for the better! Sending positive thoughts and cyber chocolates and hugs your way!

I don’t have the money to get a “real” lawyer so I’m just wondering what on earth I’m supposed to do next. 🙄

I’m just curious since I know nothing about debt consolidation, but the debt consolidation collects $2,400 total in payments in 18 months, while offering nothing of that portion to the credit card companies in the meantime? And the credit card companies can sue you because neither you or the debt consolidation company have made payments to them in over a year? Then what is the point of the debt consolidation company? Wouldn’t you have been better off using the $2,400 to make payments directly to the credit card companies and not even used a debt consolidation company?
I’m not accusing, I’m just confused by the process. I thought these debt consolidation companies make deals with the creditors so you owe less to the creditors, and they make payments on your behave? What’s the point of collecting money from you for 18 mnths if that does nothing to get the creditors off your back? I’m so confused. I guess I need to google this.
Anyways, I’m sorry. That sucks.

I also just got my turn down letter for the condo loan modification thru the Make houses affordable plan because I make too much to qualify after jumping thru all the hoops Chase made me jump thru and all the paperwork I had to send them
my new optins are
Forbearance Plan A temporary reduction in yoru current payment to provide time for you to imporve yoru financial circumstances
Repayment Plan An agreement structured to cure the delinquency ove a period of months while continuing to make contractula payments
Refinance Settlement Use of an extenal lender to pay off the Loan,possibly for less then the full amount owed
(If you do intend to retain the Porperty and cannot cure a delinquency, one of the following workout options may be available to you under the Home Affordable Foreclosure Alternative (HAFA) program
Short Sale OF Property, where we MAY accept less then the full amount owed
(Forgiveness of debt may have federal tax consequences. Consult a tex Professional)
Deed in Lieu of Foreclosure, whereby you deed the prperty to your servicer in exchange for forgiveness of all or a PORTION of the loan

I was also told a lot of creditors especially law offices will not accept any settlements

It does seem incredibly unfair that the debt consolidation company is not going to help you with this suit. To me it seems like this is exactly what they should be helping you with. And you clearly are trying to pay your debtors – dragging you to court so that you have to pay lawyer and court fees seems to be extremely counterproductive! You could use that money to pay the cc company instead. I can see suing someone who is NOT paying off their debts but suing someone who is and who is working with debt consolidation company? I think someone needs a large dose of common sense. Good luck – I hope that things work out for you.
