A new Section 9.1.ff is being added to make it a restricted activity to request or send personal transaction payments for commercial transactions. Section 9.1ff will read as follows (presented in context with its root clauses):
“9.1 Restricted Activities. In connection with your use of our website, your Account, or the Services, or in the course of your interactions with PayPal, a User or a third party, you will not:
ff. Request or send a personal transaction payment for a commercial transaction.”
Looks like we might have to get a little creative with personal payment descriptions in the future. 😉

Do they define “Commercial transaction”? I guess they must. I wonder if they intend to request copies of our previous year’s 1040 form to prove we either don’t have a schedule C, or that the business it relates to doesn’t deal in whatever it is we were getting PayPal payments for.

Same here, as that would make sense, but paypal doesn’t always make sense. :scratch:

I’ve listened to a lot of unhappy people who couldn’t recoup their losses when a deal went sour when they processed a business transaction through personal. So I haven’t used that option, even though I hate Paypal fees 😥
April 17, 2010 at 5:36 am #810984I think anything being sold won’t be able to be counted as a personal transaction. I think personal transactions to them mean sending money to a family member who really needs it or something along those lines… I really don’t like the paypal fee either but I’ve been ripped off recently using the personal transaction requested by the seller, so at least now there won’t be a choice for those of us who would feel uncomfortable using the personal transaction option. There has to be a silver lining for everything 😀
April 17, 2010 at 8:08 am #810985Well, if my experience tonight reflects the whole enchilada, looks like you have to PAY the 3+% when you send money as a gift. I just sent a small refund and had to pay the fee on it, where before there would be no charge on a transaction like that. I was given the choice of paying the fee myself on top of the money I was sending, or having it taken out of the recipient’s total.

April 17, 2010 at 11:56 am #810986I agree that it’s a silver lining for some. 🙂 You obviously have “buyer protection” with a regular payment as opposed to a personal payment. I’ve only sent personal payments to people I trust or for lower value items for this reason.
I’d guess that Paypal would be more savvy of large volume sellers abusing the personal payment option but it’s probably not something to risk your account over if you’re just selling/buying a few Windstones privately. I think the new rules start June 1st according to my email.

In the past, I’ve had to pay the percentage if I fund the payment with a card of any kind. If I fund it with a bank transfer it’s free for both parties I believe. That is, unless they’ve changed it recently. My last personal transaction must be over a month ago now.
April 17, 2010 at 5:15 pm #810988To the best of my understanding, even with the old ToS, sending money as ‘personal’ for any transaction that is business related (anything where someone is selling something to someone else) was against their ToS. Personal tab was intended for use such as sending your child some money or giving your roommate rent money, etc. Where no product nor service is being exchanged.
It was also against the ToS for a seller to request that a buyer send them money under the ‘personal’ tab or as a ‘gift’, and has resulted in account suspension in many cases that I know of (amongst the art communities where I go).
Remember, as a buyer, you have NO recourse or protection if you send money under the personal tab and the seller flakes out on you.
I don’t really see this as much of a change.

Nam defined my understanding of the original TOA. Which I never questioned because on a couple other forums I’m on that have very active flea markets, members say to never pay personal and some (harsh crowd) suggest reporting individuals to Paypal who ask you to pay that way because it is against TOA. I wasn’t aware the original TOA was being read any other way; I thought willing parties were just taking a risk (loss of protection, violating ToA) for the sake of no fees when they process a business transaction under personal.
April 18, 2010 at 2:44 am #810990Can’t STAND paypal. I recently didn’t get an item, opened a paypal claim, was denied- opened a bank claim which was decided by my bank in my favor. Paypal said I owed them the money BACK from the bank even though there is no signature or proof that I received the items. In the mean time, my account was locked and 2 people sent money without asking so I had $50 sitting in there they locked up to ‘pay towards what I ‘owe”. I called, and tried to argue it- no joke- they told me if I did not pay they would find my relatives’ paypal’s and lock them all up too until they got the money they were owed. I did not get the guy’s name and am kicking myself. I cannot believe they would say something like that. I said have fun figuring out who they are and hung up. This was a couple weeks ago, still steaming angry re-thinking about it 🙄 😡 😡
