I found a black pegasus foal on ebay and was all excited because it’s the last piece I need to complete that collection. I bought the piece with no problem and after about a week I got an email from the seller who said she had forgotten the post office was closed for the holiday (Veteran’s Day) and she would have the piece sent out the day after. I wait and wait, then I look up her feedback comments and she has had her account locked by paypal for some reason not clear to me. However, the $200 I sent her had already been accepted and was in her account. So I wait some more, emailing every other day thinking all she has to do is just mail the piece, but without any response whatsoever. Finally I file a dispute and because it’s at the $200 limit, paypal finds for me and refunds the $200. The problem I’m having is that I wanted that piece A LOT!! and although I’m happy for the refund and prompt action by paypal, I’m still out the piece I was so looking forward to having and to complete that collection! I’m really sad about it and upset about not getting the piece. I left negative feedback on her (Fran Carpenter) but it doesn’t ease the disappointment any. I tell myself that there will be another one along sometime and it’s minor in the entire scheme of things, but still…

I am dealing with a Dealer in AR who sold me a damage peacock emperor dragon, He claims there was no damage on him and it all happened in shipping but there is no pieces in the bag or box he was shipped in. He was shipped in his windstone box and bag and put in another box with peanuts so he was packed well and he stil claims he was damaged in shipping as he looked him over with a fine tooth comb “Yah right” the other lady who works there says she did not see them look him over but he claims he did and he was in perfect condition, I have called at least 4 times and they keep telling me to file a insurance claim, So far the post office will not accept the damage dragon as there are no damaged pieces showing he was damaged and I am not sure what to do so I called my credit card company and there going to see what they can do for me but so far nothing has been done so I have a $350 damaged dragon. 🙄
November 25, 2009 at 11:21 pm #793988If you paid for him by paypal, you can file a dispute with them and they will investigate. You have only 45 days after the purchase to file. Then if you still aren’t satisfied, ie, gotten your money back, etc, you can file a claim. Paypal will make a judgment and if they find for you, they will pay you $200 up front and go after the seller for the rest. That means they will take it out of the seller’s account and if there isn’t any money in the account, they will put a hold on it so if any money comes into it, they will take it out and give it to you.
They have always been very good to me, (I had 6 claims and disputes going at one time once and came out fine on them. I had pictures and was timely on all the paperwork.) I had a similar claim where the item was a large wizard and the seller wrapped it in a teeshirt and 4 pieces of hard styrofoam, no peanuts or 2nd box. It arrived broken in many pieces!!. He said it was insured and to file with the PO who just laughed at me! He fought me, the PO, paypal, and ebay about it and it took months, but I got my money back!! ($758) I haven’t lost one yet and I really hope I don’t have such bad luck with sellers again! This one never sent the piece, so all I could do is get a refund.
If you didn’t pay for it by paypal (and that just means you went through paypal even if you put the charge on a credit card) you can file a small claims and go through the court, but that is a lot less satifactory, the filing fee is $50, and you have to appear in court where ever the seller is. That’s why I always pay by paypal and if I choose to, I can still put the charge on a credit card, if there is no money in the account.
If you are really stuck, Kyrin or DragOnfeathers do good repair work.

The seller never sent me my peacock emp and just stopped communication as if that was going to really work. Paypal is waiting until the 30th for a response from the seller and if he doesn’t, I get the money back. I’m pretty sure this is going to happen because the seller just fell off the face of the planet (or something)…it’s the first time I’ve dealt with this.
I’ll have a hard time trusting eBay sellers unless they have like 100% positive feedback of at least 10 or more. I’d rather just buy from Windstone or sellers here.November 25, 2009 at 11:50 pm #793990I paid over the phone with a credit card and it seems that some windstone dealers do not seem to care if they send damaged items and just tell you to file a insurance claim and of course the post office wants to see where the damage pieces are and there is nothing in the bag/box to show them so of course they claim he was not damaged in shipping so they will not cover the insurance on him. This peacock emperor has rubs and about 15 or more chips and there is nothing in the bag or box 😕 . I am hoping my credit card company will help fix the problem.

I’m so sorry you didn’t get your piece but I bet it will come around again. And if karma has anything to do with it, you’ll get it for an even better price. Hopefully soon. If I see one, I’ll let you know.

If they are an active Windstone Dealer (someone that is a dealer for Windstone… not just someone who resells pieces but an actual retail dealer) and you have been having trouble, you may want to contact John. I’m sure he’d like to know if a legitimate Windstone Dealer is being shady.

I called this dealer several times and the one person I spoke to said that he does not care and that they did not look them over before they shipped them to me as she was there and when I spoke to the other 2 people who are run the place they claimed they went over them with a fine tooth comb and they were not damaged and I told them there is not 1 spec of dust or any pieces of the dragon in the box and bag and he says they were fine when they shipped them, The lady at the post office who deals with claims looked at the boxes, the bag and the dragon and asked where are the chipped pieces are and I said there were none and she said he was packed well and that they will not file a claim as there is no damage to the boxes they were shipped in and there are no chipped pieces in the bag and box and that the dragon must of been shipped damaged so I called back and told them the post office says they were not damaged in shipping and he says the post office is lying and that the post office can not tell me they will not accept the insurance claim for the damaged and that they have to file the insurance claim for me.How do I get in touch with John?

He was packed in his bag and windstone box then packed into another box with lots of peanuts and there is no damage to his box or the other box and there is no chips, dust or anything in the bag/boxes that he was shipped in.
November 27, 2009 at 11:05 pm #793999This is so unfortunate–we all just have to be careful in our dealings and just because someone says they are a Windstone dealer doesn’t mean we can completely trust them it looks like. It’s good you can get your money back with paypal but what a headache! The scammers and whatnots are going to be out there–I rather take my chances here! Makes you feel that if they don’t have 100% feedback and less than 10 transactions, you don’t want to bother! I came across one seller that stated that if you had less than 10 she would delete your bids off her item! She had bad dealings with such ones! I hope all works out for you drgnlvr and also you dunreining.
