        Spur of the moment on eBay one day I decided to pick up a baby Unicorn. I don’t collect the Unicorns at all but just wanted a small example of one. It looked fine in the pic but when it arrived it had a big chip out of the hoof. I had opened the box on a clear table and searched all the packing material and box for the missing piece, it wasn’t to be found. So I e-mailed the seller, conversation went as follows after I informed them of the damage:

        Seller wrote:

        I shipped everything insured so it should be covered. I did not have anything with chips in it so it must have happened during shipping. Please let me know and we will figure it out.

        I wrote:

        I walked into the UPS store and told the guy that the item was chipped and that you had insured it. He asked what the damage was, I showed him the chip and then he asked where the missing piece was. We then took everything out of the box, uncrumpled all the paper in search of the chip, checked under box flaps and everything and of course didn’t find the chip. I had previously done the same and couldn’t find it but I didn’t tell him that. His decision, based on no damage to the box and no sign of the missing piece is that it was damaged prior to shipping and was an issue to take up with the seller, not UPS. So here I am again.

        Two weeks went by and I never heard from the seller so I e-mailed them the same thing again along with:

        I wrote:

        I e-mailed you two weeks ago and have not received a response yet and only have 9 days left to file a dispute if that’s the route I have to go. I prefer not to however.

        Seller wrote:

        I don’t know what to tell you. i insured all of the statues for this reason. None of them were chipped in any way. Check my feedback on all of them.

        Anyone out there run across something like this before? With UPS or with a seller? I don’t know if I should just file a claim with eBay or what. Honestly if the chip was in the box I would just glue it on and not really care but the chip is no where to be found. The Unicorn was actually in a bubble wrap bag and there is not one fleck of anything else in it especially not a big chip…any feedback would be appreciated.

        I think that in the end, this is the seller’s responsibility, so your refund will come from them. Especially since there was no chip in the box. It’s possible that the chip fell out of the box during transit, but the chances of that are slim. I would politely let the seller know your dissatisfaction and try to work something out refund-wise.

        Did you pay for it with PayPal? That is another backup for dispute resolution. I just got my dispute resolved when the seller had insured the piece but packed badly and the P.O. refused the insurance claim. It takes a while but I got my money back.

          Open a dispute for item not as described and note that it was damaged. Make sure you are explicit that the damage was done PRIOR to shipping as paypal does not cover damage during shipping.

            Thanks for the responses! We’ll see what happens. I’ve been having some bad luck with Windstones lately, may be time to take a break 🙄

              Or maybe you need to get them from people on the White List (see Flea Market thread) who know how to package stuff properly. 😀

                Can you tell if there’s any damage on the pic from Ebay? Just a thought. Also, UPS is not the easiest to deal with when it comes to insurance claims. I’ve opened claims with them online and over the phone (our local store will not deal with this where you can actually talk to someone face to face), and I’ve received either no response or they were unwilling to help. I would open a dispute in Ebay (or Paypal if you paid that way) and let the seller deal with getting their money back as the item was not as described and they don’t seem to be willing to be very helpful.
