I was *SO* looking forward to finally getting an Emerald Sitting Spectral. I’ve been keeping an eye out for one for a while. This one even had his original hang tag, and it was one of the old silver ones. I haven’t seen many Emerald risers or sitters lately. Guess I’ll have to keep looking
The bad thing is, he was sent UPS….but in a box too small for him, with ONE piece of bubble wrap and lots of newspaper, single boxed.
And I asked the seller, specifically, TWICE, to double box him, in a box not too big for him with lots of bubble wrap, and lots of packing peanuts between the boxes. I gave him exact details in a message through ebay and I even reminded him of this all important detail on the paypal payment I sent.
He, however, was not too pleasant throughout this whole transaction, as I asked him to ship UPS, and he said he had to go down and get a UPS account and that it would take time for that to process. I didn’t trust the mail service, and with good reasons, I suppose.I’m not sure he was insured for the full $167.50, but if he was, which should I go through to get a refund-paypal or UPS? He MIGHT have survived, he was tight in the box, but he SHOULD have been double boxed. If I can keep the pieces, I’m going to try and fix him, but he won’t be anywhere good as new, and I’d rather not pay to ship him off to have him repaired (although Kyrin DOES do wonderful work!)
Assuming he’s insured through UPS, what should I do?

Check the waiver to see if the seller put insurance on it or not. You should be able to tell just how much insurance they paid for. I know that UPS here has a sticky policy. They only insure for a lost package if they haven’t packed it. If they pack it then they’ll insure it for breakage and lost package.
Have you contacted the seller? See if they’ll give you a refund or not. If not, I’d get the seller to send you the UPS reciept, then you can deal with UPS directly.
If the seller refuses to help you then go through paypal. (At least that’s what I would do)

January 26, 2008 at 4:27 pm #659605Oh ouch. That sucks about the dragon. I’d contact the seller first with pictures of how it arrived to see if they would do a refund. If they won’t, here’s the page on UPS’s Web site about their Damaged Package Claims Process. The only problem there is if proper packing materials weren’t used they may not pay up for the damage.
January 26, 2008 at 4:38 pm #659606Ouch, the poor dragon! And poor you for having to deal with such a grumbly seller. Keep a hold of those pictures, the box, all packing materials, and your transactions with the seller. You’ll need them if you go though an insurance claims process. If you requested and paid for insurance, and the seller didn’t get it for you, THEY should refund you the full amount! I had a seller do this to me once and insist that she wasn’t liable. As soon as I mentioned that she offered insurance, I paid for insurance, and she never purchased it, I got my refund.
As for the dragon, I hope that UPS doesn’t take him back from you. I’ve never been through a claims process with them so I’m not sure. But he can be repaired! I’d offer to help fix him up myself but I understand why you wouldn’t want to ship him again. Good luck to you!

Let me know what happens and if you can keep him while still getting your money back.
I hope you can keep the pieces, I really want to get my paws on this.

I normally only buy Windstones from the Factory and a company called Mist Harbor but she shiped them in the same boxes and double boxed them. So have not EVER had to go thru the Dreaded broken Windstone but I have had it happen with a Franklin Mint replacment dragos so I know your pain. I will be buying them thru Wolflodge100 from now on
January 26, 2008 at 6:53 pm #659609That is so sad! 🙁 The more I see stories like this from people winning windstones off ebay and the sellers NOT packing them correctly… I don’t know if I’ll ever try to win something unless I know the person or it is Windstone itself!
