I am so mad I am shaking…most sellers on ebay are honest, nice people…..but this auction takes the cake for rude, lying scum that inhabit ebay
I purchased this dragon for $36 a few weeks ago and the person advertised it as “NEW”…well I get the dragon in a mailer bag with no padding and it had yellow stuff on the egg and the top layer of clearcoat had been rubbed off in one spot.
I emailed the seller and they I spent double the shipping to double box and send UPS so the dragon didn’t get damaged more.
Well the seller only refunded half of my money and relisted the dragon on ebay…when I questioned seller…they said I committed MAIL FRAUD by damaging her new dragon and that she reported me to ebay for damaging it!!!!!!
OOOHHHH…NO! I should have questioned about packing and I should have gotten insurance and I should have taken pictures when it arrived.
I am having a bad spell with Ebay lately…someone kept a money order and I haven’t gotten the item I ordered after a month and now this….
I have NEVER had to leave bad feedback or open a dispute…but I did it with the fellow who kept my money order.
Now am I forced to do it again?
Any suggestions. I left bad feedback, but don’t know if ebay would do anything because I don’t have pictures of the damage and it is her word against mine…and no insurance
If anyone was planing on bidding on this, the item has more than a few marks on him and clearcoat rubbed off..
I guess we all live and learn…I just needed to vent.

and the picture isn’t of the actual piece….can’t you say something to ebay about that….

Yes, you should have taken pictures… BUT THE picture isn’t the one that they are selling in the auction and I wonder WHO’S web site they pulled it off of?
I think it is a scam! BIG scam! BUT that is MY PERSONAL VIEW!

December 5, 2007 at 8:49 am #642492Im sorry. That is such crap. Keep doind what you are doing, though. I had a bad buying spell a while back and had to take a negative. In the end it was worth it cuz the seller stopped selling Windstones.

But next time if you suspect the item broken, take pictures before opening it and then of the item itself. The fact that you sent it back she should have refunded you all of it. Did you keep all the communications you did with her? Always ask if the seller will refund you for the broken item and the shipping then wait for there answer. But don’t wait forever for their answer. After 48 hour or a few days still no answer you know what to do. If you are not satisfied with the answer insist and if they still won’t cooperate then open a dispute. And make sure you say that she is now reselling it. They might pull the auction off and demand that the item be sent to them for investigation. (that is what happend to a friend of mine and it worked the seller paid her back in full. That is the only way to protect yourself.

December 5, 2007 at 2:44 pm #642495I am going through a similar situation. I bought a LOTR bust that was supposed to be in “mint” condition, and it arrived with paint loss and small chips. He wouldn’t refund my money although I contacted him the day I received it, so I filed a claim with paypal and he replied that I was trying to substitute his mint bust for one that I already had. He claims that someone did this to him before. I have a 100% rating on ebay, and just started selling recently, and I don’t want a negative from him. Is there a way that I can give him negative feedback, without him being able to give me one. I’m pretty confident that I will win the claim, but I don’t want a neg from him, if I can help it…

It makes me so mad when sellers mislead people into believeing that their item is mint, and then don’t care about packing it well either. Then she has the nerve to blame the damage on you!!! What a jerk! 😡

Auction says refund so you should have been fully reimbursed.
I too am having a bad patch of eBay windstone sellers, not listing conditions properly at all (even when asked in emails to be sure of description in auction) and ppl charging me (over charging actually) for a shipping method that they dont even use (i.e. paying too much for shipping Priority to begin with, but they sit on it for 2 weeks and then send it First Class Mail which isnt what I paid for; paid for insurance too which they didnt do either).
Sorry youre dealing with this crap. Right is on your side. Take them to the cleaners.
