I was just reading a post in my livejournal and saw someone had linked to this auction.
Wow it looks so close to the scene in The Last Unicorn.
My thing is I’m wondering if the artist got permisson from anyone to make the sculpture, whether it be Peter S. Beagle who wrote the story and movie’s screenplay or the company who holds the rights to the film. They make no mention of it and say they have several other sculpture ideas based on the movie in the works.
Would something like this be considered copyright infringement? Should I send a note to Mr. Beagle’s agent about it?
And drats I just realized I meant to post this in the Art Section not the Flea Market. Can someone move it for me please?

that looks preverted!! Young eyes should NOT be seeing thatIt’s actually not. The Wizard (Schmendrick the Magician) got in trouble with some bandits and ended up tied to the tree. When trying to cast a spell to escape he accidently woke the tree up only to discover that it was in love with him.
How is it perverted? I watched that movie a zillion times when I was a kid and it never damaged me. You want to see something bad look for a picture of the harpy that attacked them when they escaped from the traveling circus. Now SHE needed a bra 😆

I know I’ve seen the movie so many times it’s not even funny. ‘Course some of the times I’ve watched it was to get ideas for contests at the TLU icon community I help run on livejournal.
I do know that when the movie was released on DVD in 2004 part of the reason it got edited and had three of the four curse words removed was conservative parents being offended at the tree scene and it was either that scene or the curses so the curses went. The scene was there to show that the magican doesn’t have full control over his powers and that things will often go wrong. It was inportant for showing how he grew as a magican later in the movie.
When I first saw the image posted, I was like 😯 Without a description, the tree can be mistaken for a male appendage 😳 But after reading the auction and seeing what the tree really is, I’m relieved and a bit embarrassed 😳
Anyways, I’d almost expect the starting price to be higher with all the detail and it being OOAK. Is there a big fan base for this movie (I’ve never seen it)?
Ahh I love that movie! I watched it all the time as a kid, and those scenes nor the few curse words messed me up. 🙂

I would send a note to Mr. Beagle’s agent about it. There is a lot of weird rights problems surrounding this movie, due to the fact that the movie production company never paid him rights due– however– his agent would know if there is a problem with this or not.
Fan art is a very problematic area of copyright. Many, many companies DO allow fanart. Many, many companies (understandably) do not. Only the rights owners can decide how they want to deal with fan art and especially the selling thereof.

My art: featherdust.comThere is a decent sized fan base for the movie. I have a friend who was working for Suncoast Video when it was released on DVD. They had a manager’s conference and mentioned this little “b rated” film was coming out for pre-orders. The higher ups weren’t expecting it to do very well. My friends store had over 100 pre-orders by itself (one of the higest in the district). Needless to say it surpassed their expectations enough that a 25th anniversary edition was released last year in widescreen with improved sound. *Grumbles under breath* Of course it’s still the edited version without the curse words.
Thanks for the advice Jennifer (and moving the thread to the arts section). I’ll send a note off to Conner Cochran (Mr. Beagle’s agent) in a bit about the auction. It never hurts to give him the heads up that’s for sure.
Since I had seen the movie…all I saw was the tree with the wizard..It’s a great movie. I kept looking at it trying to find something dirty about it. 😆 😆

Same here.
I’m actually a little curious to see how some of the other sculptures they mention will look. Heck I can even see folks claiming the scene where the butterfly slides down the unicorn’s horn is sexual.

My brain just said copyright too. I’m glad you contacted them. As for the adult part, you know there’s this saying that kids dont see porn up to a certain age, its the adults who do (theres some dolphin test image for this somewhere…)
I saw it at the age of 5 (woooaaahh! 20 years ago!) and never even thought of anything offensive.

It may have had improved sound but the video quality of the anniversary version is horrible. I was so sad, because I remember it vividly from when I first saw it when it was brand new, and I KNOW that the colors weren’t distorted like they are in this current version. It made me want to cry, the way the bull in particular just looked like crap, when I remember how he should have looked. (Basically all reds were completely distorted, washed out, over exposed, and just plain weird.)
I haven’t even gotten a copy of the anniversary edition yet. I want to order it from Conlan Press so Peter can get more of the money for it, but I’m still waiting on my copy of the audio book version of TLU on CD as well as my “special” copy of Two Hearts that they promised to the first 2,000 orders. They have had production problem after production problem and here it is almost three years later and I still don’t have it. Until I do, they won’t get any more of my money. I guess I’ll see if I can rent the anniversary edition from my video store so I can check it out before I decide to buy it. I would love to have the widescreen format, but not if it’s that crappy. I actually got lucky with my copy of the DVD that came out in 2004 and have one of the first ones before it was censored so it has all the curse words intact. I don’t even see why they were a big deal. They weren’t thrown in at random like curse words in many movies today. The characters had a legitimate reason to curse when they said the curse words.
