Okay, as everyone may or may have not noticed I haven’t been on the forum too much lately. Lots and lots of bad things going on on the new home front and lots of repairs need to be made by the end of September or I loose my insurance on the house. On top of that my roommate decided to up and take off in the middle of the night so no I am swinging the rent alone. I’ve been scrimping and saving as much as possible, but still come up short so here it is. I HAVE to sell some of my Windstones *cries* or I’m not going to make my deadline for the home inspector when he comes to inspect our roof! Our neighbor is being pretty uncooperative seeing his tree is what’s doing all the damage. If it wasn’t for a 70 foot oak tree completely decimating our roof I may have gotten a few more years out of it. Unfortunately, he’s putting an addition on his house and the inspector he has is the same as ours and when the inspector noticed how bad our house was when he went to approve his addition, he made it his prerogative to make a huge issue out of this all. So, joyous joy! Over the next few months I’m going to have to deal with taking down his tree myself and suing for the costs since the neighbor is being a real jerk about the issue. I mean seriously, it doesn’t take a genius to see the tree is causing moisture and shade which is in turn creating a small forest on the side of my house. ARGH!
I’m pretty desperate so I’m not looking for top dollar, but I need to get something fair. Whatever doesn’t sell I’m going to put on ebay Thursday. This is the display case in my kitchen. Basically everything here is up for grabs EXCEPT my royal hatchers , my Emerald Male ( for sentimental reasons, the very first Windstone ever) my Ruby Scratcher since he’s being saved for a repaint, and my Old Warrior. (I may consider the Old Warrior, but he was badly damaged in shipping and though I fixed him, it was like 7 years ago so it’s still pretty noticable since I wasn’t as good at it as I am now. He’s just not worth getting rid of him for the small amount he’s probably worth with the damage)
Some are going to be harder to part with then others. Here’s what I’m looking to sell right away. (no boxes)
Peacock Male (very good, flea bite or two)
Peacock Mother (very good, flea bite or two)
Peacock Young (repaired eye & repaired chips, looks great)
Peacock Mother Coiled (mint)
Peacock Scratcher (mint)
White Male (mint)
White Young (mint)
Brown Hatchling (mint)These are the ones that will be a bit tougher for me to let go of
Brown Male (mint)
Ruby Lap (mint)
Green Mother (repaired tail and wing)and of course the one I REALLY don’t wanna sell is the White Emperor. He was part of the lot I bought on ebay for 2 grand about 2 months ago. All I have left from that is him and the Lap which I am keeping. The Emperor had a damaged tail which I fixed, bit it’s still noticable since it was badly repaired to begin with when I got it *grrrrr* chances are good I won’t end up selling him unless the price is right, but with the damage I don’t think I will end up doing it.
I’m also selling some PYOs as well. I haven’t gone through them all yet, but I will post that info up soon.

Do you know any lawyers? Sometimes a letter written on legal stationery will make a big difference. And I hope you get a new roomie to help with the bills. Good luck.

Thanks ddvm. I’ve actually been dealing with this guy next door (Dave) for about a month about this issue now. He keeps putting it off, but time has been ticking and we have to get things done to our roof now before October hits. We are talking with lawyers right now who advised us to foot the costs for now to get the tree taken down and then just sue him for it later. We could also probably get a portion of the roof paid for too that way as well.
Originally we wanted to just trim the branches but the insurance company now says that that would pose a threat if there was a storm since the tree is so massive it could collapse on one of our houses it the weight is mis distributed or something like that. Not even our local electric company will come to trim the branches since they aren’t technically interfering with the telephone wires. Bad news all around.
I just get mad cause he’s adding on this huge 3 story princess tower or something on the back of his house that is like 10 feet from my bedroom window, and get this, building an outdoor bridge that connects it to his 2 story garage. The guy is nuts!Got a busted Windstone?

September 11, 2007 at 12:53 am #615240Wow, I’m surprised if he can get a building permit for something like that in the Boston suburbs, unless the rules for what they will allow is a bit more lax than they are here. Here there are town planning boards and something like that in the middle of town would totally not go over well. Every town/city is different I suppose.
I’m sorry you have to sell some dragons 😥 Hopefully you can find another housemate soon to help with the costs.
EDIT: Talked to my dad. If the tree is trimmed back, it will not fall. It’s a huge oak tree. Generally speaking, it won’t happen, especially a larger oak. Especially here in the northeast, and if the tree is healthy. We don’t get hurricane force winds inland like on the coast and even a blizzard wouldn’t take out a whole oak tree (that easily) if it is larger and healthy. He says sue or threaten to. That may get some action on his part. You shouldn’t have to foot the bill first. The only thing is the roof will have to be addressed, regardless.
Or….he says take some broadleaf plant killer to the base of the tree. The grass will be fine. When the tree dies, the homeowner will have no choice but to cut the tree down. Just a thought 😈
September 11, 2007 at 1:00 am #615241Would a chemical cleaning of the roof satisfy the inspectors? Or do actual repairs need to be done?
A proper trimming of a tree takes out all the dead and crowded branches on the inside of the tree, so the tree still keeps a balanced shape. You’d still have to deal with keeping the roof clean though.
I had to have my huge oak removed after three hurricanes within 6 weeks time pushed it to an angle. The root system was damaged so it had to come down. The problem is that the top has to be trimmed and taken down by ropes before the trunk can come down in sections. You mentioned that it was your neighbor’s tree. If it’s on his property, do you have the legal right to remove it?
Sorry to hear about the rash of problems happening all at once. If you can’t come up with the money in time, have you talked to them about an extension? If you show that you’re working on it, maybe they’ll have some leniency.
September 11, 2007 at 2:19 pm #615242Sorry to hear the bad news, drag0n. I hope you get out of this without losing too many Windstones.
September 11, 2007 at 4:12 pm #615243I am so sorry to hear about this. I know its hard to part with your Windstones 🙁
I really hope things work out for you.September 11, 2007 at 7:21 pm #615244PM’d you
I am very sorry to hear your news. It is alway hard to part with something like Windstones.
In some states it is legal for you to trim any branches, etc. off your neighbors trees/bushes that hang over on your property. You might want to check on that
September 11, 2007 at 7:50 pm #615245Yuck, sorry you have to go thru this. I think the only ones I would be interested in are the OW and Emperor. I would also like to know what PYOs you are going to sell.
